So if he gets denied. He will be legal or illegal.  Can he work. Most lawyers are not taking this his case. 

Your saying they won't send him.home???

He will be illegal and lots of illegals work. Most unlikely he would be targeted, does he live in a Sanctuary City?

Well Cleveland is a Sanctuary City so he should be OK if that is where he is. Now if he did something major all bets are off.

So what is it that you want? Do you want to divorce him, or are you still hoping to make thing work? Why are you so concerned about his status?

 

Your options are:

1. File for divorce, and let him figure out his immigration stuff.

2. Stay with him, try to gather better evidence (filing taxes as married would probably help), attend the interview with him, and stay in a marriage you obviously are very miserable in. 

 

It's up to you. I know what I'd pick.

Don't respond to the RFE, and then file for divorce.  You can file for divorce online, or wait until the courts open.  or

 

Write a letter to USCIS about your marital issues and mistreatment by spouse and send it using the RFE Cover Letter, and then file for divorce.
