Good morning 

We received and RFE and my husband is trying his best in trick me into ways to make me go forward to sending what they ask for. But I refuse. He just told his family in Jamaica it was over. He cheated on me,treat me like dog . I just found out he told someone he know he treated me bad. No lawyer want to deal with the case. Unless I am on the same page. His taxes was file single head of house hold. 

 

He said I guess I'll go home. But every day  he ask me what we gone do. They dnt even want the same pictures.  We dont have any new pictures he didn't even want to take any. Sad we got a 3 page letter basically they sad insuffient  evidence.

I think the OP may be the USC? Confusing.

Im.the petioner I was saying we received the RFE. I refuse as his wife to go any further. Really was.no question.  But the lawyers said there was nothing they can do for him.of we are not on the same.page. we have nothing they are asking for. Nothing showing bonefide marriage.

I agree, pull the I864, and hire a divorce attorney.

In that case, your only choice is divorce.  Immigration issues will belong to him.

You are no longer the peitioner.  He is the petitioner of removing his conditions.  You can choose to inform the USCiS that this is no longer a joint petition. I suggest a divorce lawyer if you're unhappy and not wanting to move forward with your marriage. 

It's his responsibility to find this evidence, not yours.

Please focus on a divorce instead of the ROC. It seems like you have been wanting to get out of this marriage for a while. File for divorce and let him figure out the ROC; that's not your responsibility anymore.

Op received the same advice way back when...

Op, sometimes we stay in situations much longer than we should and my heart goes out to you. If you didn’t want to go forward in the marriage, you could’ve moved on 18 months ago and had some peace by now. It sounds like you think USCIS will send him back if you don’t respond. I promise you they won’t. Or either you are still hoping there’s a chance it could work. In which case, I wish you well. 
 

What do you want a lawyer for? To say you have no evidence to submit? Why would you pay for that? There’s nothing a lawyer can do. You either respond to the RFE by submitting the requested evidence or you don’t and it will probably be denied. But you’re still on the hook for the 864🤷🏽‍♀️. You already knew you would get an RFE bc you purposely didn’t submit any good evidence. In my opinion, you would’ve fared better by divorcing and letting him prove his case on his own. You will have to make the choice on what you will do. But I’m most certain, he is not going back to JA, with or without the approval. For your sake, I pray you choose peace of mind. That’s priceless. Good luck.

Your right he keep asking for me to.help. when I refuse. No lawyer want to take the case because there is no evidence.  He said he just will plan to go home. Then he keep asking.me.he did his taxes as single we did not do it joint. That's an issue. I'm working.on leaving . He just told his family a.konth ago that he was done with me. He has treated me.like dog . I'm was really sick that is why I coulnd not move now Im not working due to Corona
