Greetings all,

 

My boyfriend came to visit me in the US on March 4th, 2020 from Canada on a B2 visa. We originally wished for him to stay with me for 3 months while I finished up college and he can be with me until I graduated, his flight was booked to return on 6/9/20. On 3/4/20 when he got to the airport the officer only approved for him to stay 1 month (return 4/3/20) for whatever reason. After a week we decided we wanted to get married and file for an adjustment of status. We had to wait for his birth certificate to be mailed by his family member. Finally when it comes in, the courthouses are closed because of COVID and we can't get a marriage license. We understand as long as he doesn't get near 180 day overstay that he won't get barred. Things in Louisiana seem to be on lockdown until the end of April for now. What would you guys recommend doing? Should we consider filing an application of extension (I-539)?

I think you already have your reason...sounds like they already suspected he may have wanted to stay.

It would be against the TOS to advise somebody to violate immigration law by overstaying. The legal options at this time are:

1) File for an EOS.

2) Marry and file for AOS (there are a few places still issuing licenses, but idk if any are near you).

3) Leave prior to 4/3.

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

😕 We honestly had no intention of getting married yet, just wanted to have him here with me to take care of me while I studied for my final quarter of school. We were just upset about what happened so we considered moving things up.
