Timeline

Hi all,

 

Thank you for the K1 visa guidance which has led us to be in the US together and married :) I am currently doing the AOS and wanted guidance on the following questions from I-485 if possible:

 

- Part 2, Question 2: Family Based immigrant category, am I applying as

"2.a. Immediate relative spouse of a U.S. citizen, parent of a U.S. citizen if the U.S. citizen is 21 years of age or older, and unmarried child under 21 years of age of a U.S. citizen, Form I-130" as I am now married to a USC

OR

"2.c. Individual admitted to the United States as a fiancé(e) or child of a fiancé(e) of a U.S. citizen, Form I-129F   (K-1/K-2 Nonimmigrant)" as this is the form we completed and how I entered into the USA?

 

- Part 2, Question 13: Priority Date from Underlying petition

Is it OK to leave this blank as this was blank on the I-797/NOA2 or put the application date as I have seen suggested in other posts?

 

- Part 5, Question 3: Marital History - How many times have you been married (including annulled marriages and marriages to the same individual)?

I have never been married before but should I put "1" to recognize my current marriage?

 

- Part 8, Question 1: General Eligibility and Inadmissibility Grounds - Have you EVER been a member of, involved in, or in any way associated with any organization, association, fund, foundation, party, club, society, or similar group in the United States or in any other location in the world including any military service? 

I have been part of a lot of performing arts/sports groups so should I include all of these or is this question referring to groups involving military service?

 

- Part 8, Question 61: Self-Sufficiency - Are you exempt from the public charge ground of inadmissibility?
I am struggling to understand what this question is asking but think this is "No". Am I right in thinking we need to complete the I-944 (as of Feb 24th) as well as the I-864?

 

I realise that I may be overthinking a lot of these questions so appreciate any clarification you can provide!

1. I think you should enter 2c since you entered on a fiance visa, thats what we did.

 

2. We didnt have a priorty date listed on ours, so we just N/A'ed it.

 

3. Yes, 1 to include current marriage.

 

4. Im not sure.

 

5. Yes you put no and you have to fill out the 1-944 as well as the 1-864.
