Hello!

 

We have to send USCIS our 2019 tax returns, which we just finished filing through H&R Block.  I have all of my W-2's and a copy of the filed 1040.  What all should we send?  We only submitted a transcript for 2018, but not the actual return.  Should we submit that as well, since they asked for the last year's tax return?

You dont need both tax form document options.

Youll need EITHER:
1. The most recent actual Tax Return forms copy (ALL pages and schedules of the federal return, NOT just the 1040!) PLUS any earnings statement(s) (ie. W2 or 1099 series).
This option is NOT recommended. 90% of RFEs are due to submitting incomplete tax return form copies.

OR

2. The most recent RETURN Transcript.
If the sponsor filed their taxes as married filing jointly, they will need to submit the earnings statement(s) as well to distinguish their individual income from the income of their spouse that they filed taxes with.
If they did not file as MFJ, no earnings statement(s) are needed.
This option is recommended as it is only a few pages and there is no chance there will be any errors in the form because it is the final receipt of what was filed.

You dont need 1 AND 2. You need 1 OR 2.

 

If you have filed 2019, that's all you need.

We did go for the option 2 you mentioned and they still asked for the most recent tax returns. I think they want us to mail them 2019's tax returns.

We will send both the 2018 and 2019 tax returns. We have the transcript for 2018, but for 2019 we only have the tax return form and the W-2s.

I have another question. We just noticed that we put gross income in the form I-864 page 5, where it asks for adjusted gross income.

Shall we send a corrected I-864, or shall we just explain it in the cover letter, or shall we just send what USCIS specifically asked for and ignore this for now?
