NVC Filers - April 2020

Thank you for replying back. When I saw both the I 864 EZ and I 864 (instructuos) they both looked similar.

The criteria for I 864 EZ is applicable to me so I guess I will go with it.

I did the same and got quite nervous when somebody said EZ is not recommended. 

 

I decided to give NVC a call.

I was waiting for 1h to speak with an Operator and another Hour to speak with a supervisor.

The supervisor said

" Sir if you are qualifying for the form , by no mean use it. Either way if we look up your Social security we will know what you did,  just be truthful or expected us to make you file i864.

If in the last 6 months you sponsored anyone to come

and in the next 6 months of your wife already here and you sponsored somebody.

Its all gonna be linked together and you will have to put all that in your I864 not I864EZ. no matter if you have 2 different cases or not."

If you forgot to sign, we will just make you do i864 

If you send Tax transcript but did not send w2- 1099 (I864 does not require W2, but i864EZ please send )

If you are supporting somebody and claim them on your tax then I864 

If we feel like you haven't given us a good picture of your financial situation we will want you to file I864.

 

I stopped him here and said that " But on the forum i read that people get rejected and...."

 

He stopped me and raised his voice " Sir Like I said, If someone does not qualify for it they can not file I864EZ, if we made mistake you can call back anytime. This is your marriage, read the instruction and follow it "

 

I was speechless. I honestly felt really Attacked by the Supervisor I hope from my experience It will help others, and Jeez NVC people is so pissed off lately on the phone :)

According to the instructions of I864EZ ypu do not need to attach W2s and 1099s. If you submitted the Tax Transcript. I don't know if instructions are old or every person reviewing the file has their own policy. I added the w2s with my 2019 transcript but then i read instructions and blog that it is not required so i took them out 🙃 so i guess by what you said they will want me to fill out i864 then. What a ####### shoot

What tax docs did you attach with your application?

-All 3 years tax returns (1040)

- Just the transcript and W2 for the most recent year

What I learned moat through this process is don't do what others did. Following the instructions they are not that bad. Everybody's case is different just follow what they ask you and what your case requires. Reading all the blogs just creates massive confusion and then you end up making mistakes. It's simple instructions you can either use i864ez or not, there is no in between. On the ez form it self if you answer 'no' to any first 3 question you then can't file i864ez. Simple as that.

Yes, 100%. That why i called to get a proper clearing things up. The supervisor seem annoyed with me to begin with. That why he told me " Its my marriage, read and follow" 

 

I hope everything went well for you. its only a matter of times that all this will be history.

Yea I just submitted my DS260 and AOS stuff yesterday, probably going to be while before i hear anything back from them. Even if there is any issue they will ask you to submit new form, so what? It takes 10 mins to fill out new form big deal not like you are going to be stuck at NVC forever. It's not USCIS process of approving I130 lol, that process is bigger headace.  At NVC they are basically making sure you have everything ready for the visa interview, they are NOT denying you of any Visa! Lol so everyone calm down worst has passed.

I'm sorry that you had a bad experience. Let's try to have some compassion for the NVC folks too. They probably work with reduced staff already, and now with the new EO their phones blow up due to everyone panicking and having questions if their individual file is still being processed. On top of that we call them and ask about things that we read in a forum taken from people with their own individual application which surely doesn't apply to us. It's nice to be nice, but I really feel for them as well.

NVC provides very detailed instructions on the process and their folks seem competent and helpful (from what I read - I never called them personally) but I think to often we let our doubts trick our minds and grab the phone to have them re-assure us. I know that physicians get annoyed when we do our google work and believe we know what we have rather than listening to them, and I imagine for the NVC Team it's similar stressful if we rely more on forum info than the instructions they provide :)

 

P.S. - this is by no means directed against the opinions in this forum. Visajourney and the members here are knowledgeable, which has helped me a lot. But it is what it is - opinions and experiences based on an individual case, not the guideline provided by NVC.

It takes min 2 weeks to get shipped from USCIS usually, from there min two weeks to be entered in the system at NVC. Only IOE numbers receive WL faster. I would give it until end of the week and call them early next week if they have a case number for you. Sometimes folks have success that they receive it over the phone.
