I don't think a 1040 that hasn't been sent/received by the IRS can be considered filed. Maybe others can chime in if they believe it's a good idea to upload it under the required documents even though you haven't filed yet. I personally didn't want to risk it (even though mine has been mailed already, I know that it hasn't been processed yet).

 

Not directly related, but have you filed for an extension for federal and state taxes? ITIN processing requires minimum 7 weeks (without covid delays). I had to file for extensions because I won't be able to even send my state return before I received the ITIN.

Oh my gosh I'm sorry!! I didn't realize I wrote in your quote! Thank you for your advice. I did file an extension before covid and it was approved. I think at this point I'll just wait to my husband gets his SSN and amend the 2019 tax return. I don't think I'll be getting that ITIN anytime soon!

I am sorry if this question has been asked before, but after scrolling through 50 pages of this topic, I couldn’t find the answer. Did any of you submit form 1040 in lieu of the tax transcript for the 2019 tax year? If so, what was the outcome of NVC review of your documents? Or is it a good idea to use tax transcript of 2018 as the most recent one given the fact that the filing deadline is now extended to July 15.


I am in NYC and the lockdown has been so widespread and is expected to last beyond 05/15. And unfortunately I can’t create an online account with the IRS to access the transcript due to them being unable to identify my cellphone number. I have been using a prepaid phone for years. I hope someone could share their experience. Thanks!

We actually didn't use any tax transcripts. Only our saved copies of 1040 (+whatever else we summited) from 2018 and got DQ.

Hi,

 

we submitted a copy of the whole 2019 Tax Return. We filed it on February at an acceptance agent here in Mexico City. Because We also applied for an ITIN for me. 
 

we submitted under AOS requiere documents, I-864 AOS from, 2019 tax return, 2018 tax transcript, 2017 tax transcript. And under additional documents a copy of from W7(ITIN application). NVC accepted it.  We added a note of why the 2019 transcript wasn’t available.

Thank you so much for your reply! I am glad that it worked out for you. And including a note explaining why 2019 tax transcript is not available is a great idea! When you mentioned “the whole 2019 tax return”, did you mean you also submitted state/city tax return or only 1040. Thank you!

We included W2s voluntarily and those were also in one PDF (multiple years).

I submitted my 3 years of Tax transcripts all in one file. I simply wrote on each page at the top what year it belonged to. I never saw nor read anything that said you couldn't and I was DQ with no issues.

I might have to join filing for may. Still no welcome email from the nvc.. ill give it till the end of week to give the nvc a call. Anyone with a succes story after calling the nvc?

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..

Hi! I recommend that you read the first part of the instructions for I-864ez here: https://www.uscis.gov/i-864ez

It's the shortest form and you can use it if:


1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on Form I-130; and
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal
Revenue Service (IRS) Form W-2s provided by your employers or former employers.
