At this point there is no good excuse to not upload DS-5540.

and you do need it for the consular processing (NVC). yes, they ask for the health insurance so it would make sense to upload proof of it if he has it.  if you plan on adding him to your job health insurance I`d attach a proof such as a letter from employer (we did that and some other people here too)

it's up to the CO's discretion if they ask to see it at the interview. Dept of State language is that they "may" ask for it. So far I haven't seen any DQ's or interviews at consulate where it was required (NVC didn't ask for it), but NVC has also not reached 02/24 submission date yet so we don't know if they will eventually start asking. I have tried to keep NVC submission as lean as possible, so they don't have to review papers that they don't need. 

Generally it's true, the new public charge rule applies to adjustment of status from within the US. Most questions don't apply to people that don't already have a life here :)

We did the same, On February 13, 2020 I went to an IRS certified acceptance agency here in Mexico City to apply for an ITIN and filed my husband’s tax return. We kept a copy of the tax return and the W7 application so we uploaded those and the 2018 2017 tracking transcripts. 
 

we haven’t heard from them yet. And There Is no way to call.

Where do you see that the DS5540 is needed for the NVC? I'm pretty sure it's not one of the documents required, which is also not listed on the official travel state gov website here. I remember asking my lawyer about it and she said it is only needed during the embassy interview. Please ensure your information is accurate as to not induce panic to people who have not uploaded a DS5540 to their CEAC for the NVC stage.

First of all my information was my opinion that "there is no good excuse to not upload DS 540 at this stage". now I did not say : "you gotta do it or else earth will collapse," did i? The form is in the drop out list under additional documents  so that tells you something.  It`s everyone`s opinion as to upload docs or not. Just like your lawyer and my ex-lawyer had different opinions in this case. there are multiple cases where one thing applied to some people and another to other. just like some people get approved with date printed on their forms and some get RFE for that. 

we here provide information and it`s up to people to use their head.

 

DS5540 is needed for Consular processing (NVC) not for AOS is what I meant.

I think, expediting is not really an option atm unfortunately (unless your country is not under a corona travel ban). The expedite- request email goes straight to the local embassy as far as I know and they're not open for interviews right now. At least that was the case for us...

 

I mean you can still try of course 😉👍

There is absolutely no harm in trying.  We applied for ours on March 5th and was approved on March 24th, after the suspension of routine visa processing on the 18th.  The email is worded differently in that rather than the NVC immediately sending your file to the embassy/consulate, they state that that will immediately send your file as soon as routine visa processing resumes.

Oh, that is interesting!! May I ask if you had sent your expedite request to the expediteNVC@ email address? And also, which country are you applying from? :) thank you!

Wow! We received welcome letter from nvc 2month after our case was approved. In the letter, it state the nvc case number and invoice. My priority date is Nov 2014, I’m in F1 category.  My question: we’ve paid the fees and we’ve started submitting AOS form and tax transcript. does it mean if our case didn’t become current before 1yr, we’ll need to pay the fees again?

I believe so, yes. Maybe others know for sure. What surprises me is that you already received welcome letter. Isn’t PD for F1 currently January ‘14? That would make the wait naturally almost a year 😑 I hope I’m misinterpreting though :)

Welcome! All embassies are closed at the moment, so unless the petitioner has urgent medical reasons as to why the beneficiary needs to travel asap, and the embassy processes expedite for medical reasons, chances are high that an expedite won't do anything.

CR1/IR1 visas have a visa number available immediately, so the priority date does not matter.
