yes, under the AOS section there is a dropdown for each document to be uploaded individually. I-864 and most recent transcript are under required docs, and for W2, 1099 etc you would choose the applicable description for each individual document under additional.

Hi my i130 was just approved and im working on AOS. I (petitioner/sponsor) have been living and working outside the US since 2016 (now I am back residing in US but not working yet). I am concerned because I have not done a tax return since maybe 2015 or 2016... anyone have a similar experience filing without tax returns? Or can point me to some relevant information? 

 

I am thinking of attaching a paper that explains I was not required to file because I did not work in the US during that period (based on something I read on a tax services website) I will have a joint sponsor to help cover the gaps in my records.. ill continue researching but any similar experience or advice appreciated. Thanks!

Hey! I'm not all the way through the NVC stage yet but I currently live outside the united states as well and had to back file taxes for the last couple of years. If you did not work just a lettering explaining that is fine but if you DID work you need to file.

When completing the ds260 for spouse, on the work/education section, where it asks which occupation do you intend to work in the u.s. do we fill that in? I do plan on starting to work once the kids are settled into school but didn’t want to fill it in if it’s wrong?

Hello! I have a question regarding the I-864 form. I am in Part 5 - Sponsor's Household size. My household size is 2 - my husband and me. My husband is the beneficiary and principal (only) immigrant I am sponsoring. What I am confused about is questions 1-3... it says to provide the # of people being sponsored (1), myself (1), but then it says if you are currently married to enter (1) for your spouse..... that would means that my spouse is being counted twice - 1 time as the principal immigrant, and 1 time as my spouse. What do I do?

You can write undecided or something like that. That’s what I did, and no problems :) I read that recommendation here on VJ when I had the same question.

It that part it says persons not sponsored on the affidavit and to not count anybody twice. So then when it says “if you’re currently married ...” leave that part blank or put a zero there, whatever you prefer :)

yes. you can get your transcripts in 3 weeks after you filed if you filed online and in a couple months if you mailed them.

I filed by mail and the IRS has issued a statement that they currently don't process paper filing. I did paper filing (I had no choice since we needed to apply for an ITIN for my hubby) just this week, so it'll sit there until they go back to "normal operations".

The IRS is not currently able to process individual paper tax returns. If you already have filed via paper but it has not yet been processed, do not file a second tax return or write to the IRS to inquire about the status of your return or your economic impact payment. Paper returns will be processed  once processing centers are able to reopen. This year, more than 90% of taxpayers have filed electronically.

Oh I see. that`s a different situation then. with W7 being involved you might have to wait much longer. I`d suggest to upload 2018 transcripts as your last year or upload tax return (not transcript) for 2019. Waiting for them to reopen is going to be devastating for you both. I`d say upload what you got and add a note if needed. good luck

Yep, that's what I did. Since the deadline was moved to July, 2018 taxes are still valid as "most recent tax return". We already submitted everything to NVC and are waiting for review, but this is essentially what we did for financials:

- Filed I-864ez with "current income" total from 2019.

- Entered 2018, 2017, and 2016 as the three tax returns on I-864

- Uploaded 2018 transcript under required proof

- Under additional proof, we uploaded 2018 W2 & 1099 to support transcript, 2019 W2 & 1099 to support "current income" on the I-864ez, tax extension approval from IRS (since we anticipate ITIN processing to take forever now)

 

I pray that this will satisfy the NVC team :)
