NVC Filers - April 2020

I submitted everything on Feb 1st, then added a translation on Feb 4th and then added supporting evidence and extra documents (after reading about people getting RFE for that) on Feb 24, so I wasn't expecting my case to be revised but I guess I was counted as Feb 1st.

I just wanted to validate, that once you submit, you can keep uploading documents?

 

i inquired with NVC, and i asked about my police clearance. They said to write n/a and explain why. So I would submit my file to NVC and upload any missifn docs late (since it take min 2 months to look at anyway)

Do we know if embassies will open on a country by country basis or all at once when things have calmed?

 

I did hear someone saying they were given dates in April but at the moment I am not seeing anything that really confirms this is happening. 

 

Just thoughts as I try to fall asleep.

Hi guys.

 

Regarding the I864ez on personal income, Part 5 where it says: My Federal Adjusted Gross Income, what should my husband (Petitioner) put if his income in under the Foreign Earned Income Exclusion?

 

We have ordered his Tax Transcripts a long while back but it hasn't reached us. Appreciate if someone can let us know which line item in the 1040/WE form this amount refers to.

Just found out that they have send our case to the NVC yesterday.. (approval march 30) still no noa2 in the mail. So it will take some time before we receive the welcome email. They are working now on cases received on march 25th..

Feb 14 2019: Send I-130(a)
Feb 19 2019: Delivered

Feb 21 2019: Received NOA1 assigned to Nebraska Service Center

Oct 2 2019: Send I-129F

Oct 7th 2019: Delivered

Oct: 11th 2019: Received NOA1

March 30th 2020: I-130 Approved 

April 13th 2020: Case received by the NVC

May 1st 2020: NVC Welcome email received

May 1st 2020: Paid Bills, processed on May 5th 2020

May 15th 2020: First initial submission

May 26th 2020: Final submission

June 1st 2020: DQ NVC

Waiting for interview letter..

His dad will be our joint sponsor, so my question is: when we eventually have the money to pay the fees, should we go ahead having the taxes information just for 2019 or wait until we have the previous years? I saw some conflicting information about this since his dad will provide his information also.

I got my I 130 approved on the 8 of April, I am  still waiting patiently for the approval notice from USCIS and the notification mail from NVC.Hoping that this does not take long.

I'm so sorry to hear you've both lost your jobs. I hope this all calms down soon and you're able to get back to work and some normalcy.

 

You're only required to show the most recent years tax transcript, showing 3 years is optional, and I believe that's still the case even with a joint sponsor, but someone please correct me if I'm wrong. I would still work to resolve the past years taxes though.

I’m a corporate attorney (not an immigration attorney, unfortunately) so perhaps I can shed some light. 
 

I don’t know whether his income is W2, 1099, etc., however, there indeed are certain situations in which you aren’t required to file a personal federal tax return. The instructions for form I 864 (check out the first paragraph on page 9) indicate that if you were not required to file a Federal tax return under US tax law because your income was too low, you can attach and explanation. Similarly, if you didn’t have to file due to an exemption, you can provide an explanation and indicate how that exemption applies to you.

 

If he otherwise did not file or pay taxes for no good reason, I highly encourage him to file. You will probably be subject to a host of fees, penalties and interest (if you have any tax liability for unfiled years) but you can schedule a payment plan with the IRS.

 

As I said, I’m not an immigration attorney so I’m not exactly certain how his failure to file will affect the AOS (not positively, I imagine) but you can still show you’ve filed late and have arranged a payment plan.

Ever since I saw the email I have been ringing every two minutes, hanging up after hearing the first few seconds of the automated message and then ringing again... I was on the phone from 2pm to 12am yesterday and since 9am today.... and NOTHING. I just sent a public inquiry with my questions, in hopes that by the end of next week I can get some answers in case their phone lines continue to be so saturated.
