hello I have a question my grandma got a deportation order with a court date which she did not go to she just went back to her home country... this was around 05/2007

it was because on her way across the border she had someone that was illegal. she hasn't been back since do you think its possible for her to come back and what has to be done?

could she come in a visitors visa? Thank you!!

Always possible, but odds are against her.  Regardless, she won’t know unless she applies for a B2.

Okay... does she just have to applying for B2?? 
Or any waiver?? As well?

Yes unfortunately.. she wasn’t aware he wasn’t legal.. and at the border everything happened and they didn’t arrest her they just gave her a court order but she was scared and decided to leave the us that same day and has been there since 2007.. and I’ve read that after 10 years she can reply we have gotten her FOIA as well..

That sounds like an Immigration Judge, what about the Criminal aspect?

 An INA 212(d)(3)(A) waiver is available for nonimmigrant visa applicants inadmissible under INA 212(a)(2)(H).

If the Consulate Officer deems her otherwise approvable for a visitor visa  a waiver may be requested.

Okay so first we have to apply her for a visitor visa? Correct? She would have to do that at her home country or can we do it within the us?

That is beyond incredible that she would believe it was legal.

 

$160 and a trip to the consulate ti find out if she can get a visa.

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

She applies for a visa and is interviewed at her local consulate, presumably the same process as she went through previously.
