The issue is USCIS does not have the ability to make extensions on the timeframe to marry on a K-1. The 90 days is in the law. USCIS cannot change laws, only rules & policies. They do not have the flexibility to do so here.

Congress + the POTUS would have to get involved to change it.

I believe California is state which allows notaries to issue confidential marriage licenses (https://www.nationalnotary.org/knowledge-center/news/law-updates/ca-assembly-bill-1102which is another avenue you can look into, such as this guy (first Google result for "notary marriage license california"): https://www.jacobmarries.com/license.html

Thanks a lot for this information, this is very useful! However, I have concerns that the USCIS may suspect on our decision to have a confidential marriage license (in this case, the only motive would merely to accelerate the process and avoid hitting the K1 visa limit period). I've been researching a bit further on this but I can't find any evidence or requirement from the USCIS that the marriage needs to be done through a Public (and not Confidential) marriage license.

Do you know if this would be accepted or rejected by the USCIS? The latest thing we want is an unexpected delay of the visa process or even a denial when submitting the AOS later on.

I'm sorry, I'm not sure as I only saw people on Facebook saying that they went that route. We went the email legislators route and it worked out for us so I recommend that.

I'm in the similar situation, also live in Texas and have been calling counties.

My fiancee is scheduled to be here in first week of May, which will begin the 90 days.

When did you get to the US? Your interview date was in November?
