K1 Visa I-134, Affidavit of Support, Got laid off recently!

Hi all,

 

I'm expecting my NOA2 really soon as the my case status "Case has been approved" on USCIS website. I like to prepare things earlier or at least understand what's the next steps and documents that I should be getting ready.

 

As I'm gathering information I-134, Affidavit of Support while waiting for my NOA2 to arrive, my fiance got laid off few days ago because of Covid 19. So my question now is, should we start looking for a co sponsor? Cause I'm quite sure my fiance makes enough a year to be above the 125% of HHS Poverty Guidelines. 

 

But to be safe, what should we do? Should we start looking for a co sponsor or even if his assets and taxes files for previous years are above the poverty guidelines? 

 

Even if his assets and all that is enough, we still need submit the employer's letters in the package. 

 

Anything help or comments would be appreciated! :)

Since no interviews are occurring for the foreseeable future,  you have time to see what will happen relating to the petitioners employment

CURRENT income is key.....not what was filed for tax purposes in past years.  Assets can be used to supplement income.  But, as @payxibka said, you have time.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The answer is not that cut and dry with a Yes or No answer. Many factors weigh in on the outcome at the interview. Each embassy is different in how they treat the use of assets for the financials. My experience with the Philippines is that they will not except assets for a K-1 but will for a CR-1. But, in the end about four years ago they stopped asking for financials from many applicants. A few were asked but most were not. If it were me, I'd have a co-sponsor for the interview in the event your asset submittal is not excepted. 

 

Here is a quick FAQ on using assets to qualify under the K-1 income value.

 

Q: How Can I Use Assets to Qualify?

A: Assets may supplement income if the immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the fiancé visa applicant and converted to cash within one year without undue harm to the sponsor or his or her family members.  You may not include an automobile unless you show that you own at least one working automobile that you have not included.

 

Q: What assets can be used?

A: Any type of asset can be used if it is readily convertible to cash within a year. Liquid assets, such as savings deposits, stocks, bonds, and certificates of deposit will be viewed most favorably because they would be most accessible for the support of sponsored immigrants. Other assets, such as property, may also be acceptable if they can be sold within a year.

 

Q: What evidence of assets is required?

A: Evidence establishing ownership and the value and location of assets is required. Information on any liens and/or liabilities relating to these assets must be provided. For bank accounts, bank statements for the most recent 12 months, or a letter from the bank stating the date the account was opened, a history of deposits and withdrawals for the past 12 months.

 

Q. How much money do I need to show to bring my fiancé to the US?

 You must meet either 125% of the poverty guidelines or meet the asset requirement. If unable to do either, you will need a joint sponsor.

It's been almost 3 months and my fiance is still unable to find a job due to Covid-19, guess I should seriously consider a joint sponsor...😞
