i-944 form - Liabilities / debts for the household or just immigrant?

Hey! The  liabilities / debts section comes under Part 3 in the form which states 'Your AND your household members' assets, resources, and financial status.' I just moved here to the US so i don't have any loans / debt but my husband has some college loan. Do i need to list that? Or just leave it blank and assume this only applies to me? Thanks in advance!

All household liabilities and debts should be listed.  Yours and his.

That is how I read it as well, however legally when we got married I think we assumed each others debts didn't we?  That is why I think we have to list both.  Any evidence to the contrary on that?  I would really love to list the applicants debts which are zero.

The assets states household the debt is the applicant's. At least thats how I read it and completed it.

Hello, those who filed i-944 already....Did your hear back from the office which option is correct? If stating only the applicant's liabilities or for the whole household? Thank you for the reply

Hello,

I am also stuck on this question and I am filling the form for my mother. 

 

Part 2., as applicable:

A. You;

F. Any individual who provides to you at least 50 percent of your financial support, or who lists you as a dependent

on his or her federal income tax return.  ( is this me the Petitioner? Eventhou I haven’t listed her as dependent but will in the future?)

 

Do I list myself the petioner in my mother’s household?

 

Would love to know how others did this part as well. Thank you

People are currently filing the i944 right now. Because its new and processing times are very long, no one that has filed it has had it adjudicated yet.

 

Please read the form carefully and interpret it literally. The asset section asks for assets and resources of everyone in the household. The liabilities sections only asks for your debts. You, the immigrant are filling it out, so when it says you or your they mean you.

 

@vistoria are you petitioning your mother? If so mom is the immigrant. She needs to fill out the i944 not you. If you are going to help her, you need to view the questions as if you were her. The instructions state list any individual who provides you (mom) at least 50% of support. So do you or any one else provide mom with 50% or more in support? If so she will list you or them as a household member.

Thank you Villanelle. Yes, I ( the petioner) am filling out the form i-944 for my mother. Thank you, that is what i read the form is asking. No, I dont not provide more then 50% of her support. BUT in the future If i do list her as dependant on my taxes, that doesnt apply to the form in the Present, Correct?

@vistoria The form is asking about the present facts. If you are filling the i944 that means your mom is in the US presently. Does she have income? Where does she live? If you could provide some more information you can get more specific advice.

 

Again since the 944 is new and hasnt been adjudicated yet a lot is unknown about how they are going to assess them. Unfortunately everyone filling it right now are the guinea pigs! Typically when a new form or a form is changed it takes a while for USCIS to process them and figure out any glitches or issue follow up clarification memos. There are a few large watchdog type groups that submit complaints but first they need the guinea pigs to go through the process. Right now the only information/advice available is 'practice pointers' from those advocate watchdog groups suggesting the best way to fill it out. 

 

One of the main issues that will eventually need to be addressed by USCIS is the fact that it says transcripts specifically. Its unknown if they would accept full copies of tax returns or not like they do with the 864. The 864 also is considered to be valid the date it was submitted. So if you submit it and its accepted and then you change jobs technically you are not required to present an updated 864 (unless you are asked in the interview if anything changed and to present and updated one). I do not know if the 944 is going to be the same way. I would assume so but its never good to make assumptions.

 

So if you fill out the 944 and then lets say you incur a debt while its processing- its recommended to fill out an updated 944 reflecting it to bring just in case they ask if everything on it is still correct. Because if something changed and they want an updated form and you dont have it you will get an RFE delaying your approval. 

 

For your specific situation- when do you anticipate providing mom with 50%+ support? If you are not providing it now are you going to be providing it before her case is approved? With in the next year apx? If so you need to fill out the form with the correct information as of the date you fill it out but want to bring an updated one if things changed. 

 

For parents there are a few concerns you dont get when its a spousal based petition. Typically spousal based petitions are younger work aged immigrants. Most parents are older and retired and theres more concern about medical issues and showing health insurance. So while you do have to still fill out their education and work qualifications the answers there arent really going to be that important. If mom is 75 and retired it doesnt matter much if she has an ivy league education or is certified as a master mechanic- she is retired and its unlikely she is going to re- enter the workforce at her age. 

 

So how do your numbers fall? Are you significantly over the threshold for the 864? Does she have health insurance? A pension? How do her numbers fall (when you look at just her numbers). They are going to be looking at both the 864 and the 944. In general USCIS does not consider future plans. As odd as it may sound you may want to consider providing her with 50% support right now. Its hard to say though with out knowing why you plan on providing her with support in the future though.
