Hi all, just a quick update.  We just got our interview date for London, UK.  January 12th.  We are also an original plaintiff in the Milligan case. 

 

The Embassy set our date, we didn't have an option to choose it.

We got our interview in January as well, scheduled by the Juarez consulate in Mexico, thanks to the the lawsuit!

Congratulations, very exciting news :)

I was wondering did cases have to be from a specific country to be named as a plaintiff in Milligan case? I see many were name as plaintiffs and beating myself up for not being a part of it but was not aware when it was first happening and how to add name. 

I understand there is a pandemic going on ( I'm a nurse so I'm in the middle of it constantly) but it's just unfortunate they decided to just completely stop all K-1 issuance. Looking at NIV numbers, Nigeria has not issue even ONE K-1 visa since April. I don't know how they can think that's acceptable but doubt they even care.

Actually after reading on this some more, seems like you had to be one of the countries affected by the PP about 14 day quarantine and don't believe Nigeria was so I guess there wouldn't be much benefit in getting involved.

I look at this a little differently. These are "people" (embassy personnel) who are in front of thousands of individuals who may or may not have the virus. They are front line, much different from you as you are faced with helping those who do have the virus and I thank you for your commitment, so they are in danger also. Until the world gets a grip on this virus, we will continue to be faced with obstacles that we never had to deal with pre-coronavirus (COVID-19) pandemic. Keep strong and don't look down on others as their story is different from yours and they are just as worried about coronavirus (COVID-19) pandemic as you or I. Good luck and stay engaged in the process.

I agree and am definitely not looking down on them as I understand they are in the frontline as well. I guess my point is they just stopped all K-1s completely but not all visas. They are still issuing  B1/B2's along with many other NIVs but not one K-1 and not just Nigeria, many of the embassies just stopped K-1 as to why the Milligan v Pompeo lawsuit. I agree they should 100% take precautions. Limiting interviews/people inside, checking temps, mandatory mask to enter, and fortunately many consulates officers are already behind glass windows. I just found it hard to see how in 9 months, not One K-1 candidate in Nigeria could get an interview especially in countries with low infection rates and no restrictions. But you are right, we do have to all keep remaining strong through all of this.

The embassy in Nigeria is a very, very difficult embassy to process any visa through. They had to prioritize which visa applications they would adjudicate. Sometimes, local authority dictates what the current environment for the embassy is. The Philippines, which I am a little familiar with, can't do interviews because of local rules and then top it off with federal rules. You want to travel from one neighborhood to another, you need a pass to do so. Masks and head/eye shields required. If the embassy has their hands tied, then there isn't much we can do. Sometimes it's like the Wizard of Oz who has all the smoke, noise, and a blaring voice only to come find out it's just a guy behind the curtain pulling levers. We just haven't been able to find the curtain to pull back on USCIS or the embassies to understand this process and what goes into their decision process.

No. Mexico is not a banned country but the lawsuit got us an interview.

I honestly don't understand why the US embassy in Nigeria resumed treating all other visa categories including B1/B2 Visa category except k1, it's so sad but patience is virtue hopefully they'll remember k1 peeps soon

Did you call your US consulate referring to this lawsuit? I'm thinking doing so cause our file has been sitting in the consulate for over 2 months already with no packet 3 notification nor nothing from them

They don't accept phone calls. I'd emailed them the lawsuit and explained that we are plaintiffs a couple of times but they didn't do anything.  Once they got the order from above, they emailed my fiancé and told him the interview date and time.  All plaintiffs at this consulate had our interviews scheduled for the same week regardless of when the NOA2 dates were.  But only plaintiffs.  They are starting to reschedule non plaintiffs that had their interviews already scheduled, but not others stuck at the NVC like we were.

Yes! And she had her medical this past Monday and interview this coming Thursday!
