Hi @Greenbaum, is it necessary to have all documents (Form I-134, Letter of Intent...) to be originally signed or a copy is good enough? And other documents such as Birth Cert, does it have to be an original one or a copy of the original is fine? Appreciate your help.

I-134, Affidavit of Support can be a copy. Scanned from the petitioner and emailed and printed off in the beneficiary's country is fine. All important documents should have an original and a copy where the CO will keep the copy and hand you back the original. Refer to your embassies P3 instructions for further explanations of what is needed.

Hello,

 

Is it possible to get our case that is stuck at NVC transferred to a different embassy?

For example; can my fiance go back to her home country of Australia (currently living in Canada so we filed for Montreal embassy) and have her interview there?

Doesnt look like any K1's have been scheduled at Montreal and there have been several processed through Australia.

Once you have the case number that is how you will navigate CEAC to view your status. Everyone with a case number from NVC can view their current status via CEAC. 

 

The K-1 process is quite strange. For a time, it is both a non-immigrant and immigrant visa type. That is why the links (what you received in the email) will send you the process for immigrant which would be the I-864 and DS-260 even though it truly is a non-immigrant visa requiring I-134 and the DS-160. As you go through the stages, within the NVC system you look up your file under immigrant (ceac.state.gov/). It stays that way until after your interview and the approval and your visa is ready for issue. At that point, it changes over to non-immigrant. It truly is a non-immigrant visa with immigrant intent.

First the visa's through Australia are those that have been expedited. You are required to get permission from the Australian government to fly out of the country, that alone has added 3-4 weeks to the process.

 

If you wish to have your immigrant/fiancée visa file transferred from one Embassy to another U.S. Embassy/Consulate, please contact the appropriate U.S. Embassy/Consulate directly in the country where you wish to apply and submit Form DS-3098 for case transfer. Please click here for the full list of all U.S. Embassies and Consulates overseas.

 

The old Embassy will need to receive a formal file transfer request from that U.S. Embassy/Consulate in the country where you wish to apply. Upon receipt of this request, they will immediately forward the file for the New Embassy to process. (Expect up to a 30 day delay)

 

Once you contact your New Embassy you then can discuss the transfer of your fee if you have paid it prior to the decision of transferring your case to your new embassy. Be sure to have your payment receipt available.

 

If your case goes from embassy to embassy, then NO you don't get a new case number. The case number will began with original alpha nomenclature ie. AAAXXXXXXXXXX. If her case comes from NVC then you will have a case number starting with the embassy that you will interview in. To make your payment using your old embassy's case number you establish your profile with that case number then you link your payment to your profile.

It means you should have a quick celly and that your visa is doing what people like me are wishing theirs was doing! :D

Factually it means that NVC has mailed your application to the embassy or consulate, but the embassy has not received it yet...

USCIS is where you update your address. You'll do that whenever you are in any process may it be visa, AOS or extending your LPR status. And it goes without saying complete all "new" documents with the new address like your DS-160, Online Nonimmigrant Visa Application.

Hello, everyone! 

 

I hope everyone's doing well.

 

Just wondering, our case is with NVC already. When we filled out application for K1, we didn't put my middle name(my mom's last name before marriage). My middle name isn't on my passport and certificate of citizenship in Canada. But it's on my birth certificate. Will this cause any problems? If so, who do I speak to or clarify this with?

I'd suggest you to reach out a lawyer, I had the same situation and in my country I had to go to court and have a judge to correct my name on my birth certificate. Since they'll request your birth certificate and won't match your passport you'll need to correct it

Thank you for the information. We already completed our DS 160 and printed off our confirmation page back in June. Do we need to redo it or update it or leave it be?

You can do either; leave it as is and update at the interview or create a new DS-160, Online Nonimmigrant Visa Application. USCIS requires address change whenever they occur so use the link and get that completed. Good luck and stay engaged.
