APRIL 2020 K-1 NOA2 to NVC to EMBASSY

Hey everyone. Quick timeline share:

NOA1 - Dec 16, NOA2 - Mar 31. Case passed to NVC on May 4th. No NVC number yet. Starting to collect documents for interview.

My question will be: what documents should be required with Affidavit of support?

From what I have found online it is:

1. Form I-134 Affidavit itself

2. Bank statement

3. Employee stationery with date of employment and position

Should I also provide Tax return for the last year? Is there anything else I missed?

When did you find out it went to NVC? Did you call this week?

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both, the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g. letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.). You may download the I-134 affidavit at https://www.uscis.gov/i-134

Get the IRS transcript in place of the actual 1040 here:

Also, the new requirement from the embassies is to complete the DS-5540. https://eforms.state.gov/Forms/ds5540.PDF

@Greenbaum FYI, your URL on the income levels has a period in it that needs to come off.  https://www.uscis.gov/i-864p

I'm still a bit away from joining one of these threads, but wanted to ask while poking around - Since the I-134 is something the beneficiary brings with them to the interview, is it typically mailed to the beneficiary?  Or do people print out scanned copies?

Thanks for the heads up on the URL. I'll fix that.

The I-134, Affidavit of Support can be scanned and emailed to the beneficiary where they can print at their location and take to the interview.

@Greenbaum sorry it's too late but I have a question, how should I answer this question? This is my ds-160. No body has ever filed a petition on my behalf aside my fiancee right now, is it referring to any other previous petition?

The key word is FILED. Not approved or completed. So has anyone ever FILED for you besides your current petitioner (in this case, you = beneficiary). If so YES, if not NO. Most answer it NO as they have never had a case FILED for them prior to their current petitioner.

We received our case number from the NVC finally, but the bad news is our lawyer never let us know about the two year home residency rule that my fiancé has from a J1 visa in 2018. We submitted an advisory opinion today to the DOS, and hope they will change it. She was subject to it because of the skill set on her DS form, but she was just working as a housekeeper and for her separate J1 visa in 2019 she was not subject to the rule while working as a waitress. Also no money was taken from any of the governments involved, and all of her friends who worked the same job as her both summers did not receive it. I consulted with another lawyer and they believe the officer at the embassy marked it just to be sure she would return home when the visa expired. We are hoping and praying the advisory opinion will clear everything up and not effect our process much.. just another bump in the road, but I am positive we will overcome this no matter what.

Anybody’s NVC app go out today? French embassy opened yesterday so was hoping mine would go out but status still shows at NVC

No one as of late has indicated that a shipment went out to the embassies from NVC.

@Rob Beri do you have any updates? I just called today and got my case number but she said they are not shipping to Pristina :(

No, Pristina is still under lockdown with a few restrictions being lifted. Hopefully, by the end of this month, or early June things will ease up and embassies will reopen. That is when we should expect for our petitions to be mailed.

Hang in there. I would suggest that you keep calling at least once a week. I received news that my petition was received last week. I am sure you will hear similar news soon.
