If you are having a problem with your case and USCIS is responsible and you have tried all other means to move the "log jam" then there is another tool to use and that is the USCIS Ombudsman. My reply was to your "complaining" of the efforts put forth my USCIS. You are not the only one that reads these posts and the answers to them. 50 cent words. Oy Vey!!

My date is April 2nd . I did hear anything yet. I think tomorrow I can do a inquiry about my case. The March 2020 chat said they only reply with some automated response telling you to wait because of Covid and blah.

My date is April 2nd too! I was planning on submitting my inquiry as soon as the "receipt date for a case inquiry" marks April 3rd. Is that an acceptable move to make? Would that annoy the CSC agents? Should I wait a few more weeks to submit an out of normal processing time inquiry?

I just imagine Covid19 is making things function differently. It's hard to get backlog information.

Many this week have rolled past the normal process time with USCIS. After contacting an inquiry as outlined on their website they are getting a pad answer. See more details on what to expect here:

It’s pass the date did you inquire? I didn’t as of yet .

Yes. At first I tried to get a hold of a CSC agent over the phone, but I couldn't get passed the automated system. So as soon as the processing time chart passed my date, I submitted the OPT (outside of processing time) online form on the USCIS website. I figure we will be seeing similar trends as March filers. Most March filers submitted the inquiry form as soon as they could. Then, they got responses around 15-20 days later. If they got a reply specifying their petition is being adjudicated, then they got their approval within a week (give or take).  I'm hoping this trend will be similar for us. Fingers crossed and good luck!

This is my reply . Nov 24th. I will hear a response. Hopefully it will be approved before then . Fingers crossed 🤞

Just a hypothetical question since obviously I'm not at this stage yet, but if my fiance gets denied at the k1 visa interview, do we have to do the I129f process all over again or can we just redo the k1 visa interview and till keep our application that we had currently? 

 

And should I try to be there with her when she does the K1 visa interview?

She needs it regardless of whether or not she's ever been convicted of a crime. If she hasn't, then the certificate will show that ;)

The K1 visa can be denied at either the USCIS level or later at the US Embassy. In either case, a denial suggest that something is wrong with your application and you will likely need professional help to fix the problem. K1 Fiancé visas that are denied by USCIS can be appealed. Once denied, USCIS will provide you with a written notice of denial and instructions for filing an appeal. If you chose to file an appeal, you will have 30 days to do so. Unfortunately, filing an appeal is expensive. The filing fee for an appeal is more than the filing fee for the original application. Another alternative when your application is denied by USCIS,  is to re file your Fiancé Visa petition. This means you are starting over and many times this is the best way to proceed. Whatever problems or deficiencies that where present in your first application can be completely avoided by re filing.  Its also less expensive than an appeal. K1 Fiancé Visas that are denied by the US Embassy or Consulate have no formal recourse. Although there is no formal right to an appeal, you can try to contact the Embassy and asked for a review by the Embassy’s Consulate General or a Supervisory Officer. You will need to act quickly because once the case is sent back to USCIS for revocation, the Embassy no longer has jurisdiction over the case and therefore cannot change its decision.  If you are able to obtain a review by the Consulate General or a Supervisory Officer and its still denied, there is nothing more than you can do. You only recourse is to apply again or get married and apply for a marriage visa instead.
 
As for both of you attending the interview, it is up to the US Embassy where your fiancé's interview will take place. Not all embassies allow that. Check with the embassy specific to you for that information. If they allow you to attend, I would go if I were you.

You have a few choices. You received some good advice from @Jessica &Josiah E. Another item to consider is to marry and file a CR-1/IR-1 as it's rear that these get turned down. But if you or the beneficiary has something in your past that prevented you from the I-129f, Petition for Alien Fiancé(e), you'll need to get that sorted out first. Good luck and stay engaged.

There are two police certificates that are in play here. You have your local PC and you have any international PC's. International PC's are required if the beneficiary has lived in another country for more than six months from the age of sixteen and for every country that he/she has lived in that meets that criteria. Also, if a crime was committed in another country the disposition of that case must be presented at the interview. Get this all sorted out before the interview as these items take time to secure. Good luck and stay engaged.
