I-765 before I-485?

Hello,

 

Has anyone filed their I-765 (application for EAD) before getting married and applying for AOS? I understand if this is done, one has to pay the $410 fee in advance or request it to be waived. Just wondering if this is generally admitted. Do you know how to request fees being waived? I am thinking of filing I-765 and then paying the fees later, with I-485/AOS application.

 

It might not be worth it, but for us as long as we're not married - with the current crisis we can't get a priest to officiate our wedding until churches re-open - we can't file for AOS. Perhaps being able to work even remotely here in the U.S. in the meantime could help.

If you apply for EAD, even right after entry, you have to pay the fee.  Now it takes longer than 90 days for the EAD to be adjudicated, so the petition will be denied as the I-94 won't be valid anymore.  Basically it's a waste of your time and your money.

The i765 filed under category a(6) will have an expiration date the same ad your i94 (90 days from entry).  Considering it is taking at least twice that long to process it,  you do the math and see if it is viable or a waste of money

You might want to consider a small legal wedding before the I-94 expires....then a religious ceremony later......that way, you can file Adjustment of Status sooner.  In addition, If you marry after 90 days, you will incur a fee for the I-130 you will have to file.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
