Timeline

Hey everyone. I am a green card holder (10 year one) and I have SSN and I filed taxes for the last 3 years jointly with my husband. I have an SSN card that is "restricted" - "valid for employment with DHS authorization" . I got that card when I still had my "employment authorization" and I never went to update my status with SSN office when I became a permanent resident. Never had any problems , green card and SSN that's all my employers needed. This year I suppose to get my citizenship so I thought to make a trip to SSN office after that and update my status with them as a citizen but with this virus situation I don't even know. 

Am I going to get that money if I just do nothing?  or do I need to update my resident status with SSN?

Let me verify my calculation.  Lets say 2020 i get a $1000 credit.  My wife came over in 2019, we married and will be filing jointly as soon as her son gets his SSN.  This would mean for 2019 taxes when we file will be

2 adults (with ssn)

2 children (with ssn)

my 2018 taxes included only me and my daughter.

 

I would receive 1700 now due to 2018 taxes and claim the credits for my wife and stepson on 2020 taxes in 2021.

 

  1000 (refund without care act)

+3400 (care refund)

-1700 (advanced refund)

2700 (1000 + 1700) = 2020 tax refund.

02/16/2018: Met online on a mobile game called Guns of Glory

10/03/2018: I129f sent

10/05/2018: NOA1

02/26/2019: NOA2 

03/19/2019: NVC received

03/22/2019: NVC case # assigned

Its available to LPRs. Period.   It says nothing about only being available to LPRs who have taken the time to get the unrestricted SSN card

Depending on when you file the 2019 return and if that is before or after the cutoff of when they determine the advance rebate calculation, you will either get:

1) 2019 return: $1200 x 2 + $500 x 2 = $3400

2) 2018 return: $1200 + $500 = $1700

Yes, $1700 in advance if you don't file 2019 before the cutoff.

But the eligible credit on your 2020 taxes would actually be $3400. So you would get the difference ($1700) added back into your 2020 return.

How about someone who filed 2018 taxes with foreign income MFJ via mail, US Citizen with SSN and spouse (me) had ITIN but no LPR at time of filing. I still don’t have an LPR for that matter (but I understand that immigration status doesn’t matter here). 
 

Do either of us get the money? And since we filed via mail, do we get a check? Or does foreign filing (with foreign address) completely rule us out?

If you have not filed 2019 taxes by the cutoff for the advance calculation, they will use the 2018 return to determine eligability.

My understanding of the bill being voted on today is that no advance would be available as you are not eligible for the credit under the 2018 circumstances due to the lack of a qualifying identification number (your spouse's ITIN) - unless you were in the military (they have an exception for this).

When you file 2020 taxes, you would be able to claim the credit, assuming you have an SSN at that time.

   The cutoff for them to calculate will be some time before they mail the checks. No one knows exactly when, but likely some time in April. The checks will have been mailed by July 15th. Hopefully!!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am going through AOS, have work permit, and we already filed jointly with my USC wife for 2019 taxes (and got a refund from this already)

Is it whats claimed through the tax situation that matters or do you actually need to be LPR ?

My understanding is that immigration status is not relevant.....tax status is relevant....

Hmm thats odd. have it based off 2019 taxes but yet cut off is before those taxes due date (july 15th)?  id doubt.  by sounds of it it will be off 2019 tax status, but if 2019 isnt filed they use 2018...hence why it can be extra credits in 2020 taxes... for if your taxes from 2018 > 2019 changed.

   It is an advance credit for 2020 estimated from your 2018 tax return, or your 2019 if you have already filed. If your 2019 return has not been processed by the time they are ready to send out the checks they will use information from your 2018 return. They are not waiting until you file to send you a check. They are going to start issuing the checks out ASAP.  If you are entitled to more than you actually get, you will have to claim the difference on your 2020 return.

 

  If they made the cutoff July 15th, people wouldn't get the checks until September. They made the priority to start issuing them as fast as they can.

 

  You are correct, it will be direct deposit if that was the way you elected to get your last refund.

The date has not been sent. Supposedly they want to send them in April but May is more likely. Obviously this would be before the new 2019 tax filing date. If they waited until July 15th, then had to wait for mailed returns and such to be processed, it would basically eliminate the purpose of having the advance rebate...at that point, just wait for the 2020 taxes. The goal here is to get the checks out as quickly as they can.

Did you file 2019 with an SSN or ITIN?

LPR status isn't a factor.

Exactly. cutoff for eligibility is 2019 tax income aka july 15th  Eligibility is SSN.

 

I dont think i ever mentioned a cut off being relevent to when they send check.  Im talking cut off for eligibility.
