Did anyone use I-864EZ instead of I-864?

I'm going to file for AOS from K1 soon and I keep reading about different ways of doing it and getting information on different forms.

 

I just read on a website where they guide you through AOS that "form I-864EZ can't be submitted with adjustment of status"?? I'm puzzled. I thought I read in the instructions that we could use it. 

 

Part 1: Qualifying to use Form I-864EZ

1.a. I am the petitioner of the family member sponsored on this affidavit. YES/NO (Use Form I-864)

1.b. I am using my own earned or retirement income, which is documented using IRS Form W-2. YES/NO (Use Form I-864)

1.C. The sponsored immigrant is the only person immigrating based on the underlying visa petition. YES/NO (Use Form I-864)

 

> Item Number l.a. Select “Yes” if you are the petitioner who is filing or who has already filed Form I-130, Petition for Alien Relative; Form I-129F, Petition for Alien Fiancé(e); Form I-600, Petition to Classify Orphan as an Immediate Relative; or Form I-600A, Application for Advance Processing of Orphan Petition.

 

Just curious to see how many people opted for this form as opposed to I-864. It seems that sometimes reading more ends up making me more confused. 🤪

As a K1 AOS applicant, the petitioner/sponsor would have never filed an I130 for you.

You do not meet criterias 1 and 2 and you must meet ALL 3 criteria.

 

Ensure you have read the instructions for the form as well as the form.

It COULD be used for a K1 AOS applicant who did not marry within 90 days and who now has to file an I130 WITH I485 to adjust status.

That's not you.

Oh I see. I didn't gather that at all from the thing I cited. I thought the petitioner who would check "Yes" to the first question... could have filed any of the forms that are mentioned there besides I-130. In any case, it did seem confusing that they were mentioning "I-130" specifically in the instructions. Not in the form itself though. So weird. Anyway thanks for your response!
