Another question since I am using my parents transcripts all in the same address. My parents claim my brother that is dorming. Would my brother also be counted as a household member?

I'm lost.  Your parents would be joint sponsors.  One of them is the joint sponsor and the other is they household member.  Joint sponsor files I-864 and the spouse the I-864a.  YOU, as petitioner file your own I-864 whether you have income or not.  Your sibling does NOT count in YOUR household, only the household of your joint sponsor.

I was going to add my parents as household members since we reside in the same address,so I was going to add i864a for them. So my question was in what part of the i864 household size should I include my sibbling?

Whether adding them as household members is the correct procedure is still the question.  Why would you be adding your parents as household members instead of using them as joint sponsors?  Usually, that would be the wrong thing to do.  Instead, they should be joint sponsors.  I'm telling you I think you're doing it wrong, so asking the wrong question.

So it doesnt matter if we reside in the same address? I would add them as Joint sponsor not household members?

Yes, but you did not answer my question.  WHY were you thinking of adding them as household members.  For what purpose?

Ok, I was thinking of adding them as household members so I could include their income as well since I'm right below the 125 percent of poverty level. With their income added I am well above the poverty level. Therefore I was going to add a i864a for them.

If their income qualifies them to be the sponsors, the correct method is one I-864 from you and the same from one of them plus the I-864a from the other.  Unless THEY need to combine income with you, for THEM to qualify, that is the correct procedure.  The method you have in mind is backwards.  It's not about YOU needing to combine income. It's about whether THEY do.  ONLY if their income NEEDS to be combined with YOURS, would you use the method you had in mind.

 

When using them as joint sponsors, your initial question about how to count your sibling on YOUR affidavit, becomes moot.

I understand now. So I would have to submit 2 different I864 and one I864a? The i864a being for the parent with the lowest income?

 

I'm just confused about this since I was paying an attorney to do this and he started filling out i864a for both my parents to combine their income with mine. I then got rid of him since he had made so many mistakes with names and income totals.

Unless the attorney is an expert in FAMILY BASED immigration, he probably has little practical knowledge or experience with the I-864.  You are NOT "confused" though.  You have two opinions.  Make an educated choice and proceed.
