Timeline

Hi all, 

In 2019 I sponsored my mother to immigrate to the US and now she is a green card/permanent resident living with me. 
In Feb 2020, I got married to my husband in Pakistan. 
In 2017, 2018 and 2019 I made an average of $79k per year at my government job. ($99k/yr in 2019). 
I am now preparing the CR-1 application and wanted to know
Is my income enough to sponsor my husband on my own or do I need a co-sponsor?

does the USCIS care if you have previously sponsored your parent before and are responsible for them financially and prevent them from becoming a public charge? 
please share.

The answers to all your questions are contained in the I 864 form and instructions.  Best to read them. In short 

yes should be acceptable  

no joint sponsor needed if 1 is yes 

yes .. they very much care

They "care" in that people previously sponsored and now Green Card holders, DO count in the sponsor's household size when sponsoring additional immigrants.  Second study of the instructions and the form itself.  All those questions are answered in those two documents.

Facts are cheap...knowing how to use them is precious...

You don't submit the sponsorship (I-864) later in the process.

 

For the income requirements refer to I-864p and the appropriate I-864/I-864w form

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

You are now preparing a petition for alien relative.  The visa application comes after that petition is approved.  Whether you will qualify to sponsor your spouse will depend on your current income at the second stage of the process, something like a year from now.

I 864 is the second step in the process I will read the instructions. Thank you

Yes it’s the second step. First I need to submit the I 130 and I 130a

Yes I will do so but was wondering. Even with my mom living with me, it makes us a household of 2 people which will still put me above the income limits.

Your household size would be three.  You, the intending immigrant and your mother you already sponsored.

I am sorry but that wasn't meant to be rude, at all. I was just confused how was the POE was 2011 when you just got married. (Until I saw this post.) Please do not take any offense for that. It was just a question out of curiosity. Love ❤️
