Need urgent help with K1 visa

Hi everyone,

Well I have a problem and I need suggestions. My fiancee visited me only once in March, 07 for two weeks. Then we had a small engagement ceremony at my place. But the main problem is that at that time her divorce was not finalized. It will be finalized on 20th June 07.

I have pics of engagement ceremony. My question is should we send those pics with the I-129F petition. Or should we send the pics of us together only.

We have to file the I-129F petition within next two weeks.

And If we send those pics with petition then should I show the engagement pics at the visa interview. My interview will happen at New Delhi Embassy.

I guess they will freak out when they come to know that her divorce was not finalized.Even we were aware of that we exchanged engagements rings. I guess they will reject me. :crying:

Should I hide the engagement info or not. Please help me out. I'm scared right now.

Many people started seeing their SO's before divorces were final. Pictures, I'm sure, were taken before divorces were final. Pictures are secondary evidence at best. All the USCIS is concerned with is that the petition was filed AFTER the divorce is final because your fiancée will need to submit a copy of her divorce decree when filing. Primary evidence is meeting in person within two years of filing. Other evidences to back that up would be boarding passes, stamps in passport coinciding with the dates of travels, hotel receipts, etc.

Show the pics if you want...as long as the petition is filed after the divorce is final that's all that matters to the USCIS.

My divorce was not final until March of 06, (in my case we'd been separated for over 8 years), and got engaged in February 06.. I didn't hide anything and no one ever said a word about it.. I cannot imagine it will be a problem..

Hey honey, I didn't know you posted a thread about this lol. My thoughts are the whole point of the fiance visa k-1 is that you are already engaged/want to get married so why try to hide it? I know we are talking about conversative India though. =(

Most people get separated before they get divorced so if I was separated from him in Jan 07 and we got enaged in Mar 07 I am hopping it won't be a problem.

The relative date of visit and divorce final is not necessarily a reason for denial in and of itself but the fiancee of a friend of mine was blue slipped at interview and asked why he visited and became engaged to a married woman. I don't recall the other things they asked for but it seems this was what prompted the blue slip and need for overcome evidence.

If you have other pictures together and primary evidence of meeting, I would leave the engagement party pictures out of the process altogether. It is too easy to mistake them for wedding pictures. You do not want anybody making that mistake.

Facts are cheap...knowing how to use them is precious...

Definitly check out the regional forum. Each embassy has its quirks and so what is ok at the London embassy for instance is not ok at the Chinese embassy etc.

You'll need evidence of the divorce with the I-129F submittal. Photos are good, but largely irrelevant. And sorry, but I'm not clear why exactly you "... have to file the I-129F within the next two weeks." You can file the I-129F at any time. Right?

Submit evidence of having met in person within the previous two years, such as copies of the passport pages, hotel bill, airline ticket, boarding pass(es), even purchases made during the visit to the U.S.. Include your photos, as well. Remember that photos carry little weight at this juncture, though.

Because My D will be final later today. Going to the hearing today on the 20th of June. I need to get certified copies of my divorce decree as well as move into my new apartment that is under construction (I want my mail to go there) THAT is why we are waiting a few weeks. ;)
