Hi everyone! Regarding unemployment benefits:

Let's say I made 27,000 for 2019 taxes and it's a household of 2- my spouse and I. My current job is paying $35,000 a year but it just closed and I am temporarily laid off for 2-3 months. Can I file for unemployment meanwhile? I filed the I-130 about a week ago and it'll be 7-9 months before my case is accepted and processed through the NVC and they ask for financial documents 

Am I still eligible to be my spouse's sponsor if I collect unemployment for 2-4 months?

- you can file for unemployment, (note your gross income for the 2020 yr will reduce for the period you’re unemployed

- your i130 approval timeframe is variable based on which center processes it, the average timeframe (without coronavirus delays) is around 12-14 months

- when at NVC you’ll likely use 2019 tax return $27k, possible 2020 return depending on which service center processes your petition. 

- your still eligible to file while on unemployment, however it’s possible you’ll be asked to get a co-sponsor, so I’d recommend you start looking for one now, just in case. I also recommend you start saving for spousal health care due to public charge rules unless you return to employment before his arrival and have employer based insurance..

 

please update your timeline once you get your NOA1 with your PD date and service center details...it will help others assist you better
