My father inlaw, a USA citizen, filled for my now wife and her siblings, all of them were over 21 years old and unmarried at the time of application.  4 years later, my wife got married to me.  currently, her i-130 has been approved, and the NVC has sent her letter and created an account for her online, through which she will continue the process.  Her visa type/category says F11 at the first time she accessed her online account, but few days after she added her now spouse and newborn child, her visa type/category changed to F31, and it is written as summary on the page that she has to wait till visa number becomes avilable.  Please, what could be the reason, does it mean that he marital status was not frozen and she has to wait for more number of years again?

 

Any help would be highly appreciated.

The marital status is never frozen. Yes she has to wait for those lots of years.

she is still married, she was not married when her father filled initially for her, she got married 4 years after her father filled the petition and still married now, hope you understand now.

I meant she is no longer unmarried, that’s why F11 was no longer applicable. I edited my post. Thanks.

Yes we understand- when she got married, her category changed from F1 (unmarried) to F3 (married). She now needs to wait for F3 priority date to become current. F1 no longer applies to her.

susie, she was never on F1 but on F2B category

You said your father in law is a citizen. F2B is unmarried child over 21 of permanent resident. Did the father first file before he became a citizen?

Which is F1. It’s possible he filed under F2B when he was a LPR and it later changed to F1 when he became a citizen. ( And then it changed to  F3 when she got married.)

She no longer qualifies for the visa category which was initially filed for.

Yeah you have another 6-10year wait (depending on PD) because she is married. There is no concept of frozen marriage. The beneficiary must remain unmarried until they enter the US on their visa. If they get married at any point prior, they no longer qualify for that visa

Or F2B was retained, which is an option. But that no longer remained an option once they married.

OP stated the category was listed as F11 originally which I believe is F1? So I’m guessing not. Not that it matters now anyway.
