k-1 visa, awaiting green card

Hello all,

 

My spouse entered the US August 20, 2019 on a K-1 visa. We Married Nov 7, 2019 and submitted all paperwork for her green card, travel parole, and work permit. As of today we are still waiting on all of the above documents. The last thing she did was her finger prints in January and now awaiting for the interview to be scheduled. For 2019 taxes how should I file my taxes? At one point she was an au pair and had a social security card.

Either Married filing jointly or Married filing separately.........Several factors will determine which is the better filing strategy....such as income the foreign spouse earned before entering the US.......You should compare the numbers under both filing statuses to determine which is better for you.  Since she has a SSN, you can file a joint return.

 

Married-Filing Jointly will require reporting of world-wide income for both spouses for the entire tax year regardless of place of residence.

thanks for the tip. when reporting income from a foreign country, do we need to provide some sort of documentation?
