Hello All,

 

If you apply for a K1 visa but the US embassy is closed in the country that your fiancee resides in does USCIS determine where your fiancee will have to attend the interview or can he or she scheduled an interview with a US embassy in another country that he or she can travel/visit just for the interview process.

11/21/20: I-129F packet shipped via USPS

11/25/20: I-129F delivered to Dallas Lockbox (Lewisville)

11/27/20: Backdated I-129F "received date"

2/23/21: I-129F fee charged to bank account

2/25/21: Text alert NOA1 Receipt/Case Number

3/3/21 :  Received NOA1 Letter in the mail

You can not just choose a different consulate.  The consulate interview is normally where the fiance has legal residence.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

All consulates are closed.

 

To use another consulate the beneficiary must be a resident there - as in under the jurisdiction of that consulate.

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I understand they are all closed due to the coronavirus pandemic. In this case the fiance lives in Cuba and the US embassy has been closed for some time so people going through the K1 process to come to the US have had to travel to Guyana to have their interview. My question is if that's decided by USCIS.

It is decided by the US Department of State.

I think you can request your case to be transferred to another Embassy. But I also think that would be a big hassle to do that. Call NVC ask or go to ASK NVC.

You can only request for embassy transfer to a new country if you moved and started residing in that country.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete
