Hi Everyone,

 

Hope that you all are staying well and staying safe.

 

My mother-in-law is from China, and who knows what will happen there in the near future.  Regardless, she is on a tourist visa, and wishes to apply for AOS for her green card.  We are filling out the application.  My question is, can any of you good people advise a company and/or website where I can go to purchase health insurance for her?  Also, what type would be best?

Right now her only option is short term catastrophic insurance which will not cover preexisting conditions or regular dr visits. Once she has filed for AOS, and has her NOA1. she can apply for ACA marketplace insurance.

You do not have to use the Marketplace, speak to your local Insurance Broker to see what other options may be available in your State.

We are going to send in her application in the next few days.  I just want to get her insurance through her tentative stay through the application process, and if approved, then get a more permanent plan.  She is over 65.  Just wish to know what method is most prudent at this time.  Thank you!

The GC application NoA will allow her to buy through the Marketplace. Does she not have travel Insurance for her visit?

 

Presumably you have considered the long term costs of her Healthcare needs if she immigrates.

My take ... if you can afford to pay full costs of health needs , go for short term coverage .. but you had better have deep pockets because what they won’t cover can get very expensive very quickly ..

 

if it was me .. if I could afford marketplace full cover plan I would get it.  You are facing maybe 18 months until it is approved.. a lot can happen in that time .. ☹️

And what about the Medicare option, or is there one?  With the new public charge law than went into effect as of February 24th of this year, one cannot garnish public benefits for more than 12 months in their first 36 months here.  My mother-in-law is over 65.  Does this new law apply to Medicare for seniors?  Also, what is the lag time between application and actually receiving Medicare?  Anyone know?  Thanks!

Your mother in law most likely does not qualify for Medicare. Has she been working in the US for 10 years?

An LPR with less than 40 SS quarters can buy into Medicare after 5 years of being an LPR. Parts for Part A , B and D 

An LPR with 40 quarters of SS credits can receive Medicare Part A at no cost and take parts B and  D as usual
