Can my wife claim at the interview that I’m a self-employed knowing fully well that I sold the business to my brother? 
I was a self-employed when I petition for my wife. I finalized the sales of my business to my brother in February, 2020. I submitted my AOS with my 2018 tax return which reads I was a self employed. My 2019 will read that I’m a self employed too. Though I still work for the business and I’m been paid with 1099 pending when I’ll move to another state to start a different career. Her interview would probably be around May, 2020

You mean can she lie at the interview?   She will be under oath. Perjury is not a good idea.

Got you that’s why I’m asking. Because as the time I submitted the AOS I had not finalized the sales of the business. I guess she’ll have to tell the CO that I no longer own the business but I still work there or what do you think?

Except you are not an employee.  You said you were getting 1099 income.  Employees have actual employee pay stubs.

 

The visa applicant should tell the truth to any questions asked at the interview.  Chances are, if your I-864 looks good and she takes the 2019 tax return to the interview, she will not be asked any present tense question about your work.  She can say what you do at the company, and that would be true.  If specifically asked if you are self employed or still own the company, the truth is you are selling it or sold it to your brother. Truth Truth Truth.  Efforts to disguise it or lie, can be disastrous.

Thanks Pushbrk. I’m not really an employee anymore but more less like a contractor. I’ll continue to work in the business to put my brother through the business for couple of months like 5 months.
