K1 visa approved, close to expiry, what now

Hi there, was just wondering if there's anyone else in the same situation as myself at the moment.? 

I was ready to leave for the states on the 8 th may, my visa expires 21st May, so far I have found very little pertaining to this topic. There's plenty info regarding rescheduling of interviews etc, but I was k1 approved, can't find anything anywhere with regards to people who already have visas and what this ultimately means for them if the visa expires. 

I've sent plenty emails, fiance spoke to someone at the embassy who had no info regarding this matter either. Also mailed my immigration lawyer in the states, still no response. 

I'm at my wits end, certainly can't afford to redo the entire thing again.

This is still so new that nobody knows .  I hope we don't still have the same restrictions in May.  Just have to wait and see

There are provisions in the law that allow a consulate to re-validate a visa if inability to travel was beyond the control of the visa holder.  This would entail new medical exam, etc.   But there is no clear information as to how visa expiration will be handled for this current situation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

I had email the embassy in Jamaica and was told that there is no guarantee that the visa will be re-issued if it expires. If the visa will be re-issued then a medical and police report/certificate will be needed. Also stated that if possible i should try and leave for the US.

When a visa is issued, you are given six months to relocate. Unfortunately if it expires, the assumption is that it was your own doing an  there may be a real chance that they won't re-issue the visa. If i were you i would leave as soon as possible. Not to scare you in any case, mine is to tell you as it is.

Well most certainly not my doing lol.. None of us could have predicted this.

In the face of the embassy, they could count that from the time they made the visa available to you until now, you had had all that time to travel. They could count that it was your fault. How do i know such scenarios? I know of quite a few K-1s who were denied re-issuance of visas because of such delays ( not necessarily corona). The problem people have and which leads to huge disappointments down the line is that they don't see things from a consular officer, who is the determinant here. When did you receive your visa?

I got this from Bangkok embassy: 

 

Dear Sir/Madam:

 

Thank you for your email.

 

If an applicant with a valid immigrant visa wants to extend the period they can travel to the US, the Immigrant Visa Unit will need to cancel their current visa and issue a new visa in their passport.  To do this, the applicant will need to do the following, in this order:

 

  1. Contact the Immigrant Visa Unit at Embassy Bangkok to inform them of their request by email
  2. Get a new medical exam (because the visa validity is tied to the expiration of the current medical exam)
  3. Possibly get new Police Certificates issued (they are valid for one year from date of issue, so it depends when they were issued)
  4. Pay a new immigrant visa application fee

 

Since there is considerable cost to do this, we recommend applicants do not go this route until the current visa they have in their passport has either expired, or will soon expire and they are sure they will not be able to travel before its expiration.  There is no penalty for letting the current visa expire and then starting the above process, so there is no need to do this until you are absolutely sure you will not be able to travel during their current visa’s validity.

Hello, my case is very similar. Have you had any news? I see no end to this situation and no one has any information. The visa was approved and issued but the passport is under the embassy with the visa expired.

Talk to the embassy. If they have your passport, you should talk to them anyway, instead of just posting here. Send them daily emails.
