You may need to either ask to speak to a supervisor or find a real person in your area who is a marketplace navigator. The ones you spoke with probably did the same thing as me .. didn’t read below the big print.

I just wanted to provide an update. After multiple calls to the marketplace, a supervisor there finally admitted they can sell the insurance to those who file for adjustment of a status. However, because it won't be considered a life changing event, we have to wait until the open enrollment anyways. We ended buying a short-term coverage and planning to enroll later in the comprehensive one. From my personal experience it's very complicated and you have to fight to get the coverage even if you have money to buy it. These new rules put out an insurance requirement but didn't provide a way for applicants to fulfill it. We are pretty much stuck right now.

Hmm Immigration should be OK, the NoA would have started the special enrollment period.

That’s an interesting observation. It would seem from what you say that it’s much easier to fulfill for those who go the more conventional route (visa -> green card, where immigration/change of address is no question a life changing event) than those who adjust from visitor status.

They won't add him without a SSN. He applied a few days after entry, before marriage, SSA said 4 weeks. We want him to have insurance ASAP esp. with the virus going around and also to be ae to submit AOS soon.

Just have him apply for a transition insurance plan, so they can file for AOS. That's what we did for my mom. Once he receives SSN, they can cancel the transition health insurance and add him to his wife's plan.

But we haven't got NOA yet. We are filing I-130 and I-485 concurrently.

You'd think it was a life changing event but not all insurance says so.  Hubs insurance wouldn't let me be added on until open enrollment.  Immigration was not a life changing event nor did I qualify because I lost my own coverage. 

Well as far as his HR looked into it anyhow. I bet if calls had been made.

As with the ssn issue I suspect sometimes it’s staff who just don’t know because it’s not something they see regularly 

Immigration is definitely listed as life changing under ACA https://www.healthcare.gov/coverage-outside-open-enrollment/special-enrollment-period/


 

Changes in residence

Household moves that qualify you for a Special Enrollment Period:

  • Moving to a new home in a new ZIP code or county
  • Moving to the U.S. from a foreign country or United States territory
  • If you're a student, moving to or from the place you attend school
  • If you're a seasonal worker, moving to or from the place you both live and work
  • Moving to or from a shelter or other transitional housing

Note: Moving only for medical treatment or staying somewhere for vacation doesn’t qualify you for a Special Enrollment Period.

Important: You must confirm you had qualifying health coverage for one or more days during the 60 days before your move. You don't need to provide confirmation if you’re moving from a foreign country or U.S. territory.

 

 

Edit: but you can see how AoS would be hard to justify under those rules

ACA wasnt in place when I moved in 2013. Im glad it changed with that.
