Re-submission of I-485/765/864/944 and K1 Authorized Stay Expiring

Timeline

Hi everyone,

 

We are waiting for my wife's credit score that I didn't even know she had (which will be coming via snail mail sometime at the end of next week...blech).

We will be re-submitting the AOS package at that time. We were recently rejected due to using the outdated forms (as I predicted), and it took roughly 12 business days from USCIS receiving our package to us receiving it back.

 

They should receive the package about 1-3 days prior to the expiration of my wife's authorized stay (April 2nd).

If the application is postmarked prior to the end of the authorized stay (but obviously not approved by that time), would it be rejected on the basis of her being technically out of status?

1) As the spouse of a USC, overstay will not be a bar to AOS. So it effectively means it doesn't matter anyway.

2) USCIS uses the date received to determine eligibility - meaning if she is still in status on the date they receive it, she will have technically filed before going out of status.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

K-1:

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

We are kind of experiencing this, too.

 

Did re-print the documents stamped by the USCIS? Or did you just submitted the whole package again, and just change the outdated form?

We are re-printing everything in case there's some bs rule somewhere about it, but there's no indication on what they sent back to us whether it matters (received rejection on Thursday as expected).

I called USCIS to ask about re-printing forms after getting rejected.  They told me the only forms I needed to reprint were the forms that were rejected, any other forms/evidence can go back with the USCIS markings along the bottom.

Hi,

I'm facing the same issue. I rejected because missing I-944, now working on it.

Did you re-submit as the way they organize in your rejected package or you reorganize and submit it? How is your progress after re-submitting the same document with correction?

Good morning, 

 

I re-submitted it reorganized in the original way that I had sent it the first time.  I asked that question on these forums and that was the advice given to me. Now I am just waiting to hear back from USCIS, should be any day now.
