My fiance was granted his K1 visa at his interview in Montreal on March 4. It expires on August 14, 2020. As you may know, they've closed the US Canada border to nonessential travel. They keep talking about 'nonessential' as shoppers or tourists, while essential travel involves trade/commerce. Obviously immigrating to the US falls into neither of those categorires, and I cannot find any information on whether someone on a time sensitive K1 visa would be exempt from the ban or not.

 

I spent all day trying to call USCIS, Homeland Security, Customs/Border Patrol, and emailing any government entity I could think of. The US Customs/Border Patrol says that until there's an executive order stating the details of the restrictions, they don't know who all is allowed through or not. There's nothing on the white house website yet, so all I have to go by is his speech. I also asked them if an extension would be possible, but they didn't know that either since this has never happened before. 

 

Is there anywhere else I should be looking, or people I could ask about this? I'm really nervous that we could lose our visa that we worked 11 months for because of this stupid virus.

Can he leave like, now? Before they implement this?

 

But really, I know how you're feeling, no one seems to know the answer about if K1's will be able to enter or not.

 

I hope that since it is a time sensitive thing, that they can go in. I would call the embassy, (I think theres a number some place) and ask them about extensions, otherwise, we have to wait till they list out essential and non-essential things

Visas cannot be extended, but they can be re-issued.......and may require new medical exams...........

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How does re-issuing work? I was under the impression that if your K1 visa expires, you can't apply for one for the next 2 years.

The embassy is hard to get ahold of, and has largely been unhelpful in the past. There are other factors I won't get into that prevent him from just up and leaving right now. I also don't want him to spend money on a flight only to be turned away at the border.

Revalidation is rare and does not extend the time to marry from the first date of entry to the US.

If he has the Visa, he can show up at the border and find out. It's a yes or no situation. Obviously more convenient if he can drive across, then if it's a no, just turn around. No harm in trying.

Spouses are fine . . . "Fiance" is not a legal status and non immigrant and not listed as an exempted VISA Class.

@retheem As I mentioned in one of my previous replies, there are reasons that he cannot just move here "right now" that aren't up to us - otherwise I wouldn't have asked this question and he would be on a plane now. 

I spoke to the POE in Indianapolis, who said they didn't know. I then spoke to the POE in Seattle (where lots of flights go thru) and they said it should be fine for him to travel, as long as it's by air and not land. (and as long as he can get a flight.)

He said this should be the case at all POEs. I assume this is true, and that's good news, but you never know. I'll probably reach out to the NVC or the consulate to ask if they're thinking about extensions for those whose visas may expire while this mess is going on.
