K1 Fiance Visa - Nigeria

Every person is different. Every embassy is different. Every person has a different background. Every person comes from a different culture. Every embassy does not process the same as others. Every person's nationality is different. So double that for the petitioner or the beneficiary and the answer is it just takes time.

 

Can I share somethings with you that I learned long ago about this process

  • "the man with the gold makes the rules" and
  • it will take as long as it will take 
  • no one with any certainty can tell you when some process will be completed
  • Your sense of urgency will never be equaled to what USCIS, NVC or your embassy demonstrates
  • Lowering your expectations will make you a much more relaxed individual

The chance of a summer wedding was probably minimal before the virus outbreak - k1s take time. I'd say there is almost zero chance now. Everything is shutting down here - airlines aren't flying, Government offices closing etc etc. Its a bummer but the Government is more concerned with trying to prevent people dying than ensuring you can get married on your desired date.

As far as we know K-1s are exempt from the ban on immigrants from Nigeria.

A: No. The Proclamation only restricts the entry of immigrant and diversity visa applicants from the subject countries.


It is regrettable that you have allowed yourself to believe otherwise. 
 

Your bigger hurdle is physically traveling to the USA once you get your visa.  The border will be closed to you by the time you get it.

The 5-7 months is only the USCIS estimated time to approve the petition. Once the petition is approved, you are moving on to the visa process, which takes several months and longer in high fraud countries. A summer wedding was never realistic when you submitted your petition in December.

Not practical with a K-1, even from a non-banned country pre-global pandemic.  Not going to happen, sadly.

You will need a waiver but it is possible. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Don't feel bad. I have Nigerian gay friends IN Nigeria who cannot marry each other due to Nigerian homophobia...

Right now we all have to pray and hope this covid 19 virus is defeated,  as for the ban,  I can assuredly tell you that k1 visa applicants aren't affected a bit.  I think the November 2019 k1 applicants are those getting approved at the moment,  hang in there your approval will come soon.  goodluck to you..... Okay for all filing going through Nigeria K1 and spousal Visas have been approved with the waiver and folks daily have been getting their Visa. It's honestly been business as usual (well until they closed the embassy).

 

There still those put in AP for various reasons, and those who do not qualify for a waiver approval. But many still have the public charge to overcome.

 

So to OP yes your petition is still valid you have some waiting to do but it will be processed and go it's merry way to embassy at some point.

 

If you are under IR1/CR1 same applies, I know many who have been approved since the Visa Ban and have picked up there visa in the usual 7 to 14 days.

 

Just pray this Virus doesn't stop everything. But for now the embassy is closed and Nigeria is shutdown. School, churches many businesses are closed.
