Hello everyone, I used a joint sponsor for my fiance, my question is do i need to fill up 2 forms of I-864(1 for me and 1 for my joint sponsor) or do I just need 1 form I-864(for joint sponsor only)?. Thank you

The USC spouse is always the Main Sponsor. You need to send I-864 for any sponsor you're using, including yourself, and send all mandatory supporting documents.

My joint sponsor lives only with his wife but does not work and have not worked for years, do I still need to use I-864A for my joint sponsors wife?

If the wife is not contributing income to the household of your joint sponsor, I do not believe she would have to fill out the I864A.  However, if you joint sponsor is using assets that are jointly owned with the wife to meet the income requirements, then she would based on my reading of the instructions.

Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the INA. A separate Form I-864A must be used for each household member whose income and/or assets are being used by a sponsor to qualify.

I have my joint sponsor. I used my father in law. I only submitted 2 form I-864. What do you mean I864 for joint Sponsor household?

Since you are posting in the K1 section (obtaining a visa) you and your co sponsor should be filling out I-134s.

If you really meant that you are at the Adjustment of Status phase (you are no longer a K1) then each fills out an I-864.  A household member of the Joint Sponsor, like a wife, would also fill out a I-864.

 

Please fill out a timeline and update your "Filled for" to be the correct phase.

Hi Mary&Paul,

I submitted my application in February. My father in law income is above poverty and plus my Mother in law income. They're joint filled taxes. I was confused about I-864A. I thought I wouldn't need that anymore if my co sponsor income used the household income and/or assets are being used by a sponsor to qualify.

That is the point of the I864A.  It is used for other household members, oftentimes a spouse, when their income is combined with the co-sponsor’s income.
