In US on 90 days window and unable to get marriage licence

Timeline

Hi, I wonder if anyone can help, I arrived here 3 weeks ago on my K1 and my fiancée has been sick so was unable to go in person to apply for the marriage licence until today, I have since found out all of the State offices in CA are closed indefinitely to get a licence and have heard rumors this could stay closed for a month or two. I am going to try and get a Confidential licence but it still would need processing by the register office for it to be filed and to get a certified copy. I’m struggling to see how we will get all this processed and filed for AOS within the 90 days? Has anyone heard of any possible extension to the 90 days as I don’t want to accrue unlawful stay??

There's no extension of the 90 days to marry or for K-1 status.

There are some states with no or little waiting time for a marriage license that are still issuing marriage licenses. It may be best to seek out one of them. The go-to was Las Vegas (we have a helpful member who generally performs these for free for VJ members), but Nevada is impacted for at least 30 days now too.

Thank you, I will just try and do what I can in these unprecedented times, try and move forward and be hopeful that if I do accrue overstay then the circumstances will be taken into account! 🤞

As long as you marry within 90 days, you can AOS even with an overstay. Obviously any overstay should be avoid if possible...it's the same as if a tourist overstays so they are subject to removal until they file...but it won't stop you from successfully AOSing.

If the marriage happens after day 90, there's still a path but it involves more forms and fees.

We are in the same boat. My fiancé arrives in 2 days and we have no idea how the 90 day window is going to pan out for us. Hopefully offices do open back up in 30 days.

Even if you marry after the 90 days are up you can still AOS but in that case you need to file I-130 & I-130A with your AOS packet.

Hi, Kings County is still issuing marriage license by appointment. We just got ours today. You fill out the form online.

Contact your local government officials.  Registrar's office, mayor, county admin, anyone you can get in contact with.  It's possible they can make an exception for exceptional needs.  They may not know there are people like you with a K-1 that must marry within an allotted time.  If they don't accept your calls, keep going higher up the government ladder until someone listens.

 

Otherwise, it's going to be time to make a road trip to somewhere that will marry you.
