My wife received her green card in Nov 2006. We will have to file her I-751 Nov 2008. Here is the situation, both my wife and I work for an international company and they have offices in my wife's home country of Poland. I am a production manager and my wife is a technician. Recently I was asked if I would be willing to go to my wife's home country and work for several months. This may also become a regular thing, at some point I may even be asked to stay for a year or more...maybe even transfer. They want my wife to go with me as well (she is no doubt the biggest reason for them asking me). The question is how will this affect us when we file the I-751 to remove the 2 year restrictions?

The foreign spouse needs to make sure to not exceed the time she's allowed to be out of the country in one stretch or ask for re-entry permit beforehand. I'm not sure what the timeframes are but I would think that a temporary assignment of a couple of months wouldn't be an issue. Just keep in mind that being absent for extended periods of time while in LPR status will have adverse effects on the eligibility of an LPR for US citizenship.

We were thinking about heading to Europe or maybe even Africa via my current employer for awhile but I won't even touch that until Nani has her US citizenship. Once that's complete, things will get much easier in that regard.

I'm on the same boat with the small difference than we don't work for any international company.My husband and I would like to move to my homecountry (Poland as well) and set up our own business.My conditional GC expires December 2008.Anobody has an idea how it can affect removal of conditions on my GC???

A green card is for residence in the US. If you move to live and work permanently in a foreign country, the Green Card becomes invalid whether it is the conditional card or the permanent card. If you wished to return to the US, you would need to go through the whole immigration process all over again. If you can afford the time, why not wait until after you have removed conditions, then applied for and received US citizenship. That way you can freely leave and enter the US at any time.

HB,

The removal of conditions will not be affected as long as you and your wife retain your primary residence that you do not intend to abandon in the USA, and take appropriate steps to demonstrate it.

As ET-US noted, if your wife will be out of the USA for more than 1 year, but less than 2 years, then she will want to get a re-entry permit.

The way you describe it you may not be in the same boat, the difference does not seem small - it seems significant. If you are going to move your primary residence to Poland then you will no longer qualify to be a LPR of the USA.

You should discuss your plans with a US immigration attorney who has experience with abandonment of status issues, although finding such an attorney may not be easy.
