Filing for citizenship before ROC is complete

Hello Everyone,

 

I am a USC and my husband came here on a K-1 several years ago. He got his conditional green card in July 2017, so we filed for ROC in May 2019. He will be eligible for citizenship in July 2020, meaning that we could file as early as early as mid April 2020. Of course, his ROC is nowhere close to done since the processing times are so long right now. We received the notice of receipt and did biometrics last summer, and that's the last we've heard of his case. 

 

I remember reading on this forum several years ago that some people would file for citizenship before their ROC was complete, and that would force USCIS to complete their ROC so that they could process the citizenship paperwork. Is anyone still doing this? Is it even allowed? Do you think it would result in a faster process overall, or is there a risk that asking USCIS to do two things at a time will overload them :)

 

I'd appreciate any insight anyone has on this. Of course, we are looking for the fastest process to citizenship so that we can finally be done with this whole process! Let me know what you think the fastest process would be.

A lot of people have filed an I-400 before approval of the I-751.  Does it "force USCIS to complete the I-751"?  I think you will find mixed results.  Some people have been scheduled for combination interviews....while others have been turned away from citizenship interviews.  Either way, the I-751 must be adjudicated prior to the N-400.   Bottom line is that it is perfectly fine (and I personally think it is the best route) to apply for citizenship while the ROC process is pending.....good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks for your response! One follow up question - what do you mean by this quote? Were their citizen applications denied? Or was a citizenship interview scheduled before USCIS realized that they hadn't finished ROC yet, and so the citizenship interview was canceled until ROC was completed?

The citizenship applications were not denied.......the interviews were cancelled after the officer saw that the I-751 was pending......but in other cases, combo interviews have been conducted.
