You'll have to get a Joint sponsor someone whose residence is currently in the USA. And you need to write a letter stating why you were not required to file and sign and date it. Here's an example: 

 

To Whom It May Concern: 
 
    I have not submitted a copy of my Federal income tax return for the most recent year because I do not have one. I did not work and was unemployed during the years of X, X, X. Therefore, as my income was zero, I was not required to file a Federal income tax return for these periods. Thank you for the time taken in this case. 

 

Sincerely, X 

 

And you date it the date you signed it.

You will need a joint sponsor for sure, or for the US petitioner to move back to the US and get a qualifying job. Include a letter of nonfiling as was shared above

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Hi,

 

I lived abroad but still filed my taxes, not required to pay as I had foreign income exclusion, but still filed to show income. 

Even with filing, I used a parent for AOS just in case.

You would have needed the joint sponsor unless your income was going to continue from the same source, or you had sufficient liquid assets.  Sponsors do not qualify based on foreign income whether they filed tax returns or not.

Facts are cheap...knowing how to use them is precious...

Right, I did not say I qualified just based tax returns. My income transferred (company transfer to USA)  and continued. But because my new US earned income was new and not yet on a tax return, I also had a sponsor.

Probably not necessary with a company transfer and qualifying income.
