Living in the US on a visa

Hi

 

i have a quick question.  I have a family member who is here on a tourist visa.  She’s a widow, her husband passed away here, she came to the funeral but is considering the possibility to stay.  She has a sister who’s a US citizens and is willing to apply for a green card for her.  She’s been told that based on the fact she’s already living in the States, having her sister filling for her through a special process will only take 2-3 years.  
 

the other option they’ve given her is to apply as a refugee.

 

which of these two options would any of you recommend?  Do you know about siblings application lasting less than 10 years?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you.  The scenario is a little different because in the case discussed there the wife had already petitioned for the husband before she passed.

Doesnt matter. Please go to USCIS website and look for 360 widow process. She can apply providing she meets the requirements.  What country is she from? I ask because sibling sponsor immigration timeframes depend on what country you are from. Its based around what are called 'priority dates'- basically you can apply but they cant process it until the priority date becomes available. And they only give out so many per year- hence the 10yr avg wait. Most likely the attny was referring to her doing the 360 'special widow' process but to be clear the sister has no part in it.
