Hi Everyone, I raised the 2nd service request and have received no updates on the H1B appeal (sustained in June 3rd). Has anyone tried reaching the ombudsman office or any outside organization? If so, did your employer have to apply for it or can I apply through ombudsman?

Here is my timeline:

May 2019 - petition selected 

July 2019 - RFE request received/responded to

August 2019 - H1B denied

September 2019 - Appeal filed 

October 2019 - AAO received the appeal

March 2020 - denial overturned and AAO decision sent back to the USCIS 

June 30th - USCIS approved the petition

Hi IVP, What steps did you take between receiving the decision from AAO to Case Reopen. I am in a similar situation and my case was sustained on June 3, 2022 and have been waiting for over 4 months with no updates on the case. Do you have any suggestions?

Any updates on your case? I had my case relocated from AAO to Originating office on 5th Aug 2022 and nothing since

Oh that's too bad, hopefully you'll hear something soon! Have you tried checking the status online by adding your case in egov.uscic.com? They give a history of progress in most cases. 

 

I am in the California case center.

Thank you. My appeal updates weren't posted for some reason. Did you get the final approval?

HI lipi94377! First of all, congrats on having your petition finally approved.

 

I actually didn't take any steps since the case reopen was still within the timeline my lawyers were expecting. This was also during COVID when the embassies were closed, so I was in no rush. However, I've read online that some people had luck getting their state representatives to contact USCIS and ask about the status of their case. I would look into this a bit more, maybe even ask your HR if they could contact the state representative.

Also, apologies to everyone that wrote to me. The emails were going to my spam folder, so I had no idea people were writing.

Was your appeal approve finally? If so congrats! 

 

I don't have an update yet, the I129 status itstill shows that case was relocated back to the Originating office, but doesn't say anything about the appeal being sustained. The I290b status just shows that the appeal was received.

As an update in the group, my appeal was finally approved after 171 days.
