I-129F NOA2 required for I-131/AP application?

Hello everybody, I was reading posts on here detailing what other people included in their I-131/AP application along with their I-485 packet and such, it looks like some people included the I-797 NOA2 from their I-129F petition within the supporting documents for AP??? Is this necessary? On the USCIS website it says:

"For an advance parole document for individuals who are currently in the United States:

  • A copy of an official photo identity document
  • Two identical passport-style photographs of yourself taken within 30 days of the filing of this application
  • A copy of any document showing your current status in the United States
  • Evidence that your trip is for educational, employment, or humanitarian purposes
  • An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document
  • If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application"

Is this NOA2 from my K1 petition? Do I need to include that?

Also,

"Evidence that your trip is for educational, employment, or humanitarian purposes"

Do I need to include anything for this? What does this even mean?

Thanks so much for the help everyone

  • A copy of any document showing your current status in the United States I94
  • Evidence that your trip is for educational, employment, or humanitarian purposes NOT NEEDED
  • An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document YOU ARE ONLY ELIGIBLE TO APPLY FOR AP BECAUSE YOU ARE ELIGIBLE TO ADJUST YOUR STATUS. YOU NEED TO SUBMIT ALL OF THE DOCUMENTS FOR AP PROVING YOUR ELIGIBILITY FOR AOS (THUS PROVING YOUR ELIGIBILITY TO FILE AP). SEE BELOW
  • If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application" YOU ARE FILING CONCURRENTLY, STATE THAT IN ALL FORM COVER LETTERS.

NOT NEEDED "Form I131 is a multipurpose form to apply for a travel document. It is used to apply for a re-entry permit, refugee travel document, or advance parole travel document. Many of the pressing questions on the form do not apply to K1 AOS eligible AP applicants however because all travel document applicants use the same form, it may seem that way if you read into it too much. K1s use it to apply for Advanced Parole. AP is a supplementary benefit for K1s that is "automatically" (for a lack of a better word) offered to K1s filing for family based Adjustment of Status. **There WERE other kinds of AP too (DACA AP to which AP no longer applies to them but they have not updated the form and instructions for the recent exclusion of their eligibilty).** So for the reason that it's an "automatic" benefit, K1s dont need a reason to leave and return to the US unlike others applying for a re-entry permit or a refugee travel document (or DACA related AP travel document). Those types of filers DO need a reason to travel outside of the US and to be allowed re-entry. For refugees the thought is that refugees have sought refuge in the US and should not be so easily granted a benefit to travel freely (ie. taking advantage of the US benefit to allow them to stay). For a re-entry permit applicant, it's much the same. Those filers have not followed the procedure of maintaining residency status in the US and have decided to leave for an extended period of time which is not part of the deal of being an LPR. (Ie. you should be proving you want to maintain your residency in the US and not be leaving to take up extended residence elsewhere). For DACA AP applicants the thinking is that they entered the US illegally so they should not be so easily granted a benefit to leave seeing that they jumped through hoops to enter the US and to remain. So for those types of filers they are required to plead their case and are usually only granted the benefit for specific reasons as outlined. K1s do not fall into any of those categories though and do not need a reason for travel in and out of the US although the risks to travel are still the same when being paroled back into the US for anyone using any type of travel document to re-enter (that includes the Greencard too). CBP will use their discretion whether you have AP, a refugee travel document or a re-entry permit and will judge them equally upon your arrival. If you check out the form on the bottom of page 2, it will tell you there that you actually get to skip filling out the majority of the form. And when it comes to the questions about specific travel this is what should be input for those questions as they dont apply to you as a K1 AOS eligible AP applicant."

Do I need to include anything for this? What does this even mean?

Thanks so much for the help everyone

You'll need the sequence of documents that entitle you to be eligible to apply for permanent residency.
Those are:
1. Your I129F Noa2 approval notice that proves you were eligible to apply for a K1 visa and WHO your USC petitioner is.
2. A photocopy of your K1 Visa sticker that proves you were approved for a K1 visa and who your USC petitioner is.
3. Your I94 K1 entry admission record that proves that you did enter the US legally using your K1 Visa and WHEN you did showing when your 90 days started.
4. And a photocopy of your marriage certificate which proves that you married within 90 days AND that you married the US petitioner listed on your K1 visa Sticker and listed on your I129F Noa2 Approval Notice.
