Coronavirus - processing K1 (pre NOA2)

Timeline

Does anyone know if USCIS are continuing to progress the I-129F’s amid the current travel ban? 
 

I heard people had visa interviews cancelled but was wondering if we’re still likely to see progression up until that point and then reach a choke point when it comes to the point at which people are making appointments at the embassy.

 

Or have I heard wrong and things are still going as normal? 
 

As the K1 is technically a non-immigrant visa, does that mean the US are still barring European beneficiaries from moving?

 

I’m sure it’ll already have been answered - just panicking as I’m from the U.K.! 
 

We received NOA1 on November 26th.

The petition will still be processed. A petition only gives permission to apply for a visa. You have some months to go yet - it could be all over by then. Hopefully it will be. 
 

Spouses of USCs are exempt from the ban but not fiancés.

Thanks for moving this here, hadn’t noticed this area of the forum.

 

What do you mean by your above statement? I was asking about the K1 visa so does this mean if the travel ban is not lifted the process would continue as normal but I then couldn’t use the visa, given the K1 is the fiancé visa.

Correct. A fiancé visa is not an immigrant visa and you are not an immediate relative of a USC so you fall under the ban, as it stands at the moment. The visa will have a validity of 6 months from your medical exam date so hopefully this virus will be done with by then and you can move.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

The travel restriction exempts spouses of US citizens.....not fiances (unless something has recently changed).....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My thought was that staff would need to read through petitions still. So even if offices close, people can work from home... and still get stuff done. That's how I'd do it, anyway!

March 3, 2020Sent I-129f to Dallas Lockbox via USPS.

March 5, 2020USCIS received I-129f application.

March 10, 2020 - Received receipt text from USCIS for NOA1.

October 8, 2020 - Case Tracker notification for RFE.

October 13, 2020 - RFE received through mail - Response sent same day.

October 19, 2020 - App Message from USCIS saying RFE response received.

November 25, 2020 - Case Tracker App Message for NOA2  approval.

December 5, 2020 - Received hard copy NOA2 through mail. Signed up to NVC Email list.

December 15, 2020 - NVC receive documents.

January 8, 2021 - Call to NVC - New Case Number assigned. Filled out DS-160.

June 29, 2021 - Joined Lawsuit King vs Blinken.

August 3, 2021 - Case Status changed from at NVC to In Transit on NVC Case Tracker.

August 9, 2021 - Case Status changed from In Transit to Ready on NVC Case Tracker. Interview and Medical Booked.

August 20, 2021 - Medical Complete.

August 25, 2021 - Interview Complete - approved subject to Medical Documents.

August 25, 2021 - Case Status to Refused subject to Medical Documents.

August 26, 2021 - Case Status changed from Refused to Administrative Processing.

August 31, 2021 - Case Status changed from Administrative Processing to Issued.

September 1, 2021 - K-1 Visa in delivered to home address and in hand!

Of course, this is speculation.

And that's how it's probably done. Still, people might get sick and they'll get even more understaffed than they already are so everything might take a little bit longer.

We received NOA1 on November 26th.

Even if the ban is still in place when you get your visa. You can go to a non Banned country for 14 days and then enter the US

Is this really possible? i'm sure entering via this way will cause a lot of questions and issues at the US border when you arrive?

I don't think anyone has actually done it, mostly because the suggested stopover countries got added to the ban list themselves a few days later.
