Hi , I am new to this community and I could not find the answer anywhere , can someone direct me or help?

I’m 30 years old and my fiancée is 17.. would I be allowed to start the i-129 or should I wait one year? Also will my age difference be an issue? The state of my residence is california and I saw that California allows someone under 18 to marry as long as there is parental consent? Like a formal written letter signed by her parents?

very respectfully,

I'm not exactly sure on the specifics, but you are better off waiting until they're an adult. If only because this might rise some eyebrows with the CO.

In addition to obtaining parental consent in order to get married, in CA anyone who is under 18 must also see a pre-marriage counselor, appear before a judge, produce copies of your birth certificate, and even have a parent accompany you when you apply for your marriage license.

I second this option. I am a  registered marriage officiant in Nevada, and they just changed the law here. Used to be able to marry under 18 with parental consent, now only with an approved court order.

There are still some states that allow under 18 with just parental consent, so you could search those out and marry in one of those States.

I concur to wait. While not prohibited, there is USCIS guidance involved with any spouse (potential spouse may be treated similarly) under the age of 18 with a 10 or more year age gap.
