I 130 / I 485 Concurrent Filing

Timeline

My parents will be filing their concurrent application next week.  They have 1 month left on their 6 month visa.  If for some reason USCIS does not review their filing until after the 6 month stay limit, and an error is found in the application, what would happen to my parents?

Didn’t you already file in May of last year? Once the NOA1 has been received, the person is in a period of authorized stay until the I-485 is adjudicated. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

I filed days before the I485 changed, and the 944 was required.  They rejected the petition because of the I485 not being the current form.  Note, at the time of filing it was current.

 

So I received a rejection letter.  I plan to refile.  However, I have concerns if something else is found on the rfile.
