For example, UPS delivers a petition on the 24th. Ok, how does USCIS know that the date on the courier receipt is the 22nd? Isn’t the courier receipt simply what’s given to you when you drop off a parcel at Fed Ex or UPS?

 

Maybe I sound dumb, but I haven’t used an express courier in ages.

I had to go and check a package here myself to verify, but the date UPS shipped it is on the shipping label (on the outside of the box or envelope).

 

I have a set of various boxes, envelopes, etc. from different carriers here for comparison due to my current interactions with generating shipping labels (IT contractor for USPS). :D

Makes sense. But still, isn’t the shipping label different than a courier receipt, as it’s phrased in the rule? It would require USCIS to put 2 and 2 together, in seeing that the shipping label indicates a particular date and therefore the courier receipt indicates a particular date. 
 

Just seems sketchy to me, which is why I went with USPS.

It is. For instance, I can generate a shipping label for the future but order it today. I cannot back-date a label, though (set the shipment date to a date earlier than today).

With USPS specifically, I can actually mail it up to 3 days after that shipment label's date (I had to verify this was publicly disclosed before posting :P). Although they do actually provide a postmark when they get it. I can't speak for UPS, FedEx, DHS, etc...no idea on their label policies.

 

But yeah, USCIS has no way to know what is on the receipt unless you show them. If they really wanted (or if their mail room has a tool to do so, which is 100% possible), they could scan the barcode and automatically lookup the date actually shipped. But I doubt they do any such verification.

 

My guess here is that either:

1) At least 1 wrong form edition was sent for a pre-24th filing, or

2) They overlooked it or just didn't care to look at the shipment date.

We had the exact same thing happen to us with our AOS.  We had to reprint the form (which, when we checked the copy we retained and the one they returned was the SAME updated form).  We also knew that even though we were right and someone messed up, it was quicker to return the dang thing and let them get on with it than waste time trying to argue with them.

I found out I got rejected too today. They shipped my packet back with the letter saying I used outdated form. They send me the cut out from FEDEX package . And I guess they based on the day it was shipped and not the day you brought it to the courier. 
 

04/23/ - Sent my packet to Fedex office and shipped it thru express but It was Sunday , so it was shipped Monday

04/24. - Shipping date

04/25 - Received by USCIS and signed by J. Harper at 10:am

 

 

Its really stressful and devastating to know that you’re packet got returned. 😭

I guess #2 might have happened to my AOS because I included the receipt from Fedex and highlighted the date Fedex was in possession of it. They only looked at the shipping label and the day someone from USCIS received it. (Posted mine in the forum

The plain and unambiguous language of this rule indicates that if form 07/15/19 was postmarked before February 24th, it will be accepted. Form dated 10/15/19 is only necessary now, if postmarked on or after February 24th.

 

If OP sent a postmarked version of 07/15/19 before the 24th, it should have been accepted. 

 

You're right. I did send the 07/15/19 form. I even doubled checked the website right before sending it just to make sure I was sending in the correct form.

The package was dropped off AND shipped on Feb 21st which is why I'm confused about the rejection. It was delivered the 25th which could be the explanation but it's all very confusing.

It also stares the forms have to have a certain date on it. This dates reflect on the bottom of the print out. I have seen a lot of these , that everyone rushed to get in before the 24th with 2020 forms in turn is basically crossing out the post dated mark statement. 
 

one of my Clients I submitted the package on the 22nd and we now yesterday have heard back from USCIS with fees completed and issued already case numbers. 
 

Double double check your papers and dates of the forms, if correct most definitely fight it. If not most likely you’ll have to resubmit with the new publix charge ruling.
