Delaying 2nd part

So hubby and I are putting together the I130 package. Once sent, and approved, how the next set go? Mainly we arexwanting to delay the second part of the process for a year or two. Do we set when to schedule the interview and medical etc?

If filing in the US, the approved petition goes to the National  Visa Center (NVC). When all the processing is done there, the NVC assigns an interview date to you. You schedule a medical exam once you know your interview date. If you filed today, it may take a year to get to that point.

 

If you file the petition DCF to the USCIS office in London, you pick your own interview date once the petition is approved and sent to the embassy IV UNIT (maybe 3 months). You can stall one year. That office is closing so petitions must be receive by the end of March 2020.

Well given the current processing times now, depending on which processing center, it could take 7 months to 12 months just for USCIS approval NOA2. Then 8 weeks for an NVC case number. and up to 4 months (or more depending on your embassy location) from there to have a visa. SO...if your not in a hurry, then its a good plan.👍

I guess, let me clarify. Yes we are filing DCF for London. I've confirmed with London that the approval for I-130 last 2 years before going inactive. So i'm asking from the DCF point of view. But the answer that we can set our own interview date is what I was looking for. So, once approved and moved to the IV office, do they send us a package with the next step and how to set the interview/medical etc? We are shooting for scheduling things for first part of 2022.

When you do DCF you are truly on your own.

 

Once USCIS approves the petition and the consulate get it they send you a case number in a few weeks.  It took us 6 weeks to get ours in Mexico.  From then you schedule your own appointment.  If you are going to delay it then you should still contact the consulate at least yearly, preferably every 6 months, so they do not send it to the NVC.  

 

Unlike a K1, once USCIS approves an I-130 it does not expire but the consulate can send it to be held at the NVC.

 

You will need to remember that anything that would have normally been sent to the NVC in stateside processing, you will need to furnish at the interview.   The consulate will not tell you ahead of time so be mindful of what the NVC has been asking for stateside and what the consulate has on their web page.

 

Best to post in the DCF section and update your visa to DCF so you can get timely answers.

Myself and my US spouse are looking at the same timeline (wanting to move first half of 2022) we were considering starting the process late this year/early part of 2021. Can I ask what confirmation you received from the embassy pertaining to the 2 year expiry of the initial I-130? We too would like to DCF but seeing as it is ending soon and we aren't ready to move until 2022 we assumed DCF would be out the question.

Once the IV Unit in London receives the approved petition file, they contact the beneficiary by postal mail. The instructions are provided on their website here https://uk.usembassy.gov/visas/family-immigration/how-to-apply-2/

The UK forum where you originally posted this thread, is a good place to ask your questions because your procedure experience will be very much like the K1s who also book their own appointment, take documents to the interview, process with the IV Unit, and go through the same medical. Your form difference is Ds-260 and I-864 Affidavit of Support, but the routine is pretty much the same. 

 

Do you have the London USCIS website for the checklist and petition (I-130) information?

This was the response I got from the London office when I inquired with them.

 



If you file the I-130 with this office, it will be completed before we close.  Once approved, it will be delivered to the U.S. Consulate at the US Embassy to process your spouse for the immigrant visa.

Your spouse would have two years from date of approval to initiate the immigrant visa part II – 

 

Therefore, if you file the I-130 before April 1, 2020 and we approve it on June 1, 2020, your spouse would have until May 31, 2022 to initiate Part II.

Thanks for the response, was this in writing (email)? We are a little concerned that going this route we would be approved too early and have to continue before we are in a position to physically move in 2022!!

That was directly from an email I received from London's USCIS office.
