Hello all,

 

The NVC updated our case today, and decided that my father (the petitioner) did not meet the income requirements to sponsor my brother (applicant).

I know that the main option is to find a joint sponsor, if so do we have to submit the affidavit of support to NVC to review and how much time that would take, or the joint sponsor should complete the forms and provide the financial documents and we would wait to take them with us once the appointment is scheduled ?

 

(There's also a missing document that we will submit so how much time do they take ? do we get back last in line or they get back to us once we submit the document)

 

What are our options beside the joint sponsor, in case my father couldn't find one ?

 

Last question: my brother is turning 21 yo in August, do we have to notify the NVC or something in case we didn't get an interview appointment before ?

 

I feel kinda desperate and I'm worried.

 

PS: My dad's initial affidavit of support had a tax income (2018) of 25k + 6k of savings.

Is it possible to re-submit the affidavit of support with the 2019 IRS (filling for 30k for a 3 member household) and get approved ?

 

Also if this information could help, my brother was already a green card holder in the past but it's been more than 10 years since we came back home (my mom, brother and I)

Is your father applying for you brother via the I-130 form? Please fill in your timeline. Well, your father did meet the income requirements but NVC must have given a reason why they weren't approving it. I thought the consular officer has the final say?

Along with the affidavit of support, we submitted his SSA benefit statement because he's retired, we also submitted his cab driving license because he's self-employed right now, as well as his bank statement that shows his current income.
I will fill in the timeline.

In case the consular officer who rejected it, what are we going to do now ?
