Does any one know if it because more difficult to bring a child after the fiancee if we dont use the K2 for the child.

 

In this case my fiancee would like to come in on the K1 visa etc.. we marry and start the status adjustment process , job permit, residence and everything else the immigration process involves. If we dont use the K2 visa option how long will it be before my fiancee can file application to bring her child to the USA.

11/25/20: I-129F delivered to Dallas Lockbox (Lewisville)

11/27/20: Backdated I-129F "received date"

2/23/21: I-129F fee charged to bank account

2/25/21: Text alert NOA1 Receipt/Case Number

3/3/21 :  Received NOA1 Letter in the mail

Not to pry into your personal business, but is there a specific reason for not having the child come with their mother or to follow within a year?

 

I had two K-2's come with their mother and it was the best decision I made. The mother was glad that they were here so she could have their company and that she can continue to raise them herself. One was out of school and the other was a 6th grader who transitioned into "american" schools with no problems.

She would be able to file at anytime for her children. The problem is the long process that follows. It may take a up to a year or more before the child steps foot in the US. As opposed to the K2 which is a much faster process because the child's case was attached to the parent.

Valid question the child is 3 at the moment this was something that was suggested by her because she wanted to be able to get settled in the country first, learn english, learn how to drive, find employment etc.. I'm not oppssoed to either option she was just being mindful of the situation and that i have 2 children myself who split time at my house and their mother's house. Also you were not prying if i understand this forum is here to help other with the process and i asked for answers so i really appreciate your help and response.

Yes that was my fear which i explained in our conversation but we will see as every case is different.

I think the child needs the mother more than the mother needs to learn English or to drive. But that’s just my take on it.

I agree it was just a question based on a suggestion that was made by my fiancee. I will support her in either case I just explained to her the pros and cons of the scenarios. So I just posted the topic/question to see what others experiences have been with either option

I do have a question and maybe im not understanding how the K2 works.

My fiancé would go to the interview with her child and say they get approved if she decides to leave the child with her mother for a few months can the child come afterwards or does the child have to come into the USA at the same time as the mother?

In this scenario i would travel back to her country and bring the child to the USA.

I dont know if you understand what i am asking?

K-2 would enter at the same time as or after the K-1 applicant.

As long as the visa does not expire, no issue coming afterwards.

 

If the visa may expire before they can enter (generally 6 months form the date of the medical, unless certain medical conditions exist), then Follow-To-Join (FTJ) can be utilized to obtain the K-2 visa for up to 1 year after the date the K-1 visa is issued.
